Walmart employees 'ripped up woman's $100 bills because they thought they were fake'

A mother who says Walmart employees intentionally humiliated her after wrongfully ripping up two of her $100 bills while believing they were fake is taking legal action against the store.

According to her complaint: 'The cashier inspected the $100 bill, turned to another cashier and had a brief discussion, and returned to her register telling Plaintiff that her money was "fake."

'The cashier proceeded to rip the $100 bill in half without performing any counterfeit detection tests. The metallic strip in the $100 bill was clearly visible.'

After marking the bill with the detection pen, revealing a yellowish colour across it, Ms Garcia said she explained to the cashier of that colour meaning it was legitimate, having previously worked in retail herself.

Detained at the front of the store while told the police had been called, Ms Garcia claims that adding to her humiliation, the employees told curious customers in passing that she was busted trying to use fake money.

After two hours at the front, police arrived around 4.15am and proceeded to inspect the bills in question.

Following a series of tests the first responding officer, identified as Officer Edwards, returned to Ms Garcia telling her that what the Walmart employee and manager had done was a 'terrible mistake.’

'He then approached the manager, who appeared upset by what he was told by Officer Edwards,' according to the complaint.

‘After speaking with Officer Edwards, Manager Russell approached Plaintiff and sarcastically stated that the police officers said the money was not counterfeit, though he disagreed.

‘At this time, he attempted to hand Plaintiff the two torn $100 bills he had misappropriated from her. When Plaintiff objected to receiving torn bills, Officer Edwards instructed Manager Russell to replace the bills he had wrongfully taken and destroyed.

The harm was that Ms. Garcia was unlawfully detained for two hours.

The store has no power to do that. None.

Strictly speaking, the money was detained. She stuck around to get it back/resolve the situation

Secondary mission for the Secret Service is the investigation and prevention of counterfeit US Currency.

Knew that already. If the story is true, the treatment of the woman is intolerable. Checking the $100 bills is fine. Treating the woman in a humiliating and sarcastic manner is NOT fine. By the way, my contacts in banking tell me that counterfeiters are faking $1s and $5s now because people don't check them. Tell me something new, please.

According to her complaint, she was moved *by the manager* out from the check-out lane, to the front of the store and was accompanied at all times by the manager or some female employee until the police arrived. That’s a bit different than her just “hanging around, waiting to get her money back.”

I would also NB that this happened from a bit after 0100 to 0400 in the AM in the store. This is, in my extensive experience at Walmarts across the nation, when the store is being run by people Walmart doesn’t want to let the public see by daylight ... for very good reasons.

She has cause for a legal complaint.

Don’t like it. Don’t shop there.

Walmart has been good to us. Their meat is some of the best I have grilled. We save a ton of money on food by buying from Walmart.

My wife worked for Walmart before her condition got to bad to work. Walmart bent over backwards to keep her employed. She went from stocker, to a worker in the department to cashier to door greater.

They never once lowered her wages as she went down the ladder so to so speak. They never once treated to fire her when the called in because she was to weak to work.

They also paid her MORE than the local targets offered her when she was healthy.

Say what you want about Walmart, shop someplace else if you want. But at least know what your talking about. Check your local Target (or Kmart or where ever you shop) they have mainly the same products as Walmart all mainly from China.

The time for beating up on Romney will be AFTER the election, when he fails to fix our problems (assuming that he does fail economically...as he has a darn-good record in his past, so far) - so it’s best to ignore this stuff as it only helps Obama.

I noticed that you and several others joined this site about the same time (before the 2010 election), and have since been beating up “both parties”. I will hand it to the Dems, they do get in the mud, using their operatives to try to demoralize the Republican base...but we are NOT idiots, and will not take the bait.

If I remember correctly, WalMart was setting up a store some place in Canada and were told they had to hire labor union people.....Wal Mart didn’t argue, they just left the place. smart, no jobs for that town. Wal Mart is big enough to tell them to bug off...

Actually, in most of our jurisdictions, if a customer is suspected of stealing store property (and being suspected of paying for merchandise with counterfeit money would essentially be the same as stealing that merchandise), then the store is allowed, in most jurisdictions, to hold the customer for a reasonable time, in order to properly investigate the matter.

I'm not sure if such a privilege existed in that location, but it seems likely that it would, as by that time, management was involved, and they likely knew one way or the other. And the fact that this privilege does exist in most jurisdictions reflect the fact that most believe shopkeepers should have this right, for good reason. They have a lot of merchandise vulnerable to "grab and run" thefts, which would be at great risk if they were powerless to do anything.

It should be noted that there is a serious disease in America which - although ever present - has now reached epidemic proportions.

Known as “Gaping *sshole,” it is clear that this store manager is seriously afflicted.

A corollary to this fact is that the manager - though clearly a seriously Gaping *sshole - is, as so often the case these days, “not responsible for his actions.”

The stamp machines in most US Post Offices routinely return those as change if you use large bills.

Defamation of Character?

I believe that would require her to show that there was damage done to her reputation caused by other customers knowing her (or taking significant note of who she was), and reasonably believed that her detention meant she was guilty of some crime.

As customers who did not know her likely gave her no more than a passing glance, and as customers who may have known her would not be reasonable in jumping to such a conclusion, I personally would not support a defamation of character grounds for any large award, were I on her jury, unless there was some other specific evidence which shows the store went out of their way to defame her during, or after, her detention.

Laugh or cry about this... Canada, Mexico, Argentina, Chile,Venezuela,Panama and a whole bunch of other countries are in America, including the USA. Made in America and made in the USA are two different things.

But she wasn’t paying in counterfeit money. She was paying in real US currency. They ran their pen across it, it was real. The cashier blows up and shreds the bills because she doesn’t think that “100” is a valid bill.

So let’s boil this down:

The cashier, *as well as the manager*, were too stupid to know that there is a $100 denomination in US currency.

Play stupid games, win stupid prizes. And the stupid prize here is that they get to enjoy sitting in court, explaining how they’re so stupid, (especially the manager) that they don’t know what the legit denominations of US currency are.

The manager deserves to lose his job. If he’s too stupid to know that there is a $100 bill in common circulation, then he’s too stupid to run a retail establishment the size of a newspaper stand, never mind a Walmart.

“When they finally give me back my change I do something that really freaks them out. I ask to use their counterfit pen then I use it on the twenties that they just gave me. You should see the looks I get. It’s as if they dont know what to say or do like robots that are not fully programmed. Try this sometime it’s hilarious.”

Wow! Great idea. I’ll have to remember that one.

The lawyer wrote the complaint. The complaint has nothing to do with what actually happened. The lawyer is after deep pockets. He can not be believed nor trusted.

I love $2 bills. I’d always get some when I cashed the paycheck back in the States.

Back in the 1950's, I remember my grandmother got paid in cash in $2 bills. She worked at a department store, and I would sometimes go with her to the payroll office when she picked up her pay. I even have a few of the $2 bills she gave me way back then.
