Although the ACLU strongly supports same-sex marriage, a senior attorney for the American Civil Liberties Union of Illinois warned that if Chicago bans Chick-fil-A over the religious views of its management, it will be engaging in "viewpoint discrimination," Fox News reported Thursday.
The government can regulate discrimination in employment or against customers, but what the government cannot do is to punish someone for their words, said ACLU senior attorney Adam Schwartz.
When an alderman refuses to allow a business to open because its owner has expressed a viewpoint the government disagrees with, the government is practicing viewpoint discrimination, he added.
Chicago Alderman Proco Joe Moreno said he intends to block the chain from opening its second Chicago location over president Dan Cathy's position on gay marriage. Chicago Mayor Rahm Emmanuel supports Moreno's position.
Schwartz explained to Fox that "if a government can exclude a business for being against same-sex marriage, it can also exclude a business for being in support of same-sex marriage."
But we also support the First Amendment, Schwartz said. We dont think the government should exclude Chick-fil-A because of the anti-LGBT message. We believe this is clear cut.
But Moreno has already said he is not concerned with the First Amendment.

As for the Mayor, citing “Chicago’s Values”, let’s not pretend they are to be held in esteem.
This is the guy who announced they weren’t going to “arrest their way out” of the high murder rate.
In a city that already has some of the most restrictive gun control laws on the books, how is not arresting the murderers going to help?
You have nailed it! Our Constitution was based upon Natural Law. Through Same Sex Marriage, they are throwing out the concept of Natural Law. Natural Law says 'One Man One Woman.'
That is the whole idea of the 1st Amendment, the gubmnt not punishing us for our words,

There are laws, and there are unwritten rules.

Of course they cannot stop a business because of the views of it’s CEO. Not legally. There are other ways. They can make the inspections hard, they can make all kinds of trouble for a company through Fire inspections, building codes, sign codes, they can make their parking lots almost unable to get into, restrictions on parking. There are a thousand ways to attack Chick Fil A during and after construction, and these azzwipes are the type that will do it.

This is just all sorts of rich irony coming from the ACLU, imo.
They just can’t catch most of these murderers, with no-snitch being de rigueur.
Having blown their cover brazenly and publicly like this, the red tape runaround will be frowned upon in court after court. I wonder if luggbutts have made the both offers they could not refuse. And now that it’s bringing public opprobrium down on Hizzoners’ own heads, the luggbutts may be more subtle about this in the future. Still it’s rich how they tipped their hand. That won’t be lived down for a long time if ever. And it all looks bad for Democrats. (Mitt, you’d be smart to just keep your gay lovin’ mouth shut and let the Democrats self destruct here.)
We have reason to worry these same types that would deny us our basic freedoms might also be willing to kill us. It's happened before ... it's the same type - the kind that force their ideas on everyone else. I hate liberal elites. I hate the New York Times.
Liberal elites don't mind discrimination when it's against the people THEY don't like... like traditional American Christians. They're the haters.
You're right - if rights mattered more than PC 'in' stuff - creed would be covered... and they should not discriminate against us based on our beliefs.
