The Internal Revenue Service would be the “easiest enforcer” of penalties against those who refuse to comply for those who fail to not pay the tax that isn't.

“This is a penalty that will be assessed on the tax return if you choose to roll the dice and make us all pay for your being irresponsible and increase all of our health care costs...“We’re not going to tolerate that any more in America. You have to be responsible and you have to pay a penalty if you choose not to be..."

More tot he point though vigorously ignored so far is the FACT that as a tax bill the lting sonofabitch int he Oval Office does not have a Constitutional right to exempt his campaign donor base from the taxes ... the waivers little barry bastard commie has been issuing are a violation of his designated powers under the Constituion. Will the feckless pubby House do anythign about it? ... They won’t even raise the issue!

So, if you are too poor to buy health insurance, you have to comne up with a way to pay a tax?

The amount of ObamaCare tax is calculated based on income. So, as always, we who pay federal income tax will pay for the freeloaders.

There is one last chance to have the Court reverse itself, but it will take a lot of coordinated effort and good timing.

Since Roberts did rule the mandate a tax, and Roberts said that a tax can only be challenged once it's assessed, then we have to have a tax assessed and then challenged as an unconstitutional tax.

We still have to have the Congress move to repeal Obamacare, but we also have to have a court challenge ready to go once the government begins to collect the tax.

Once a mandate tax is assessed, Republicans have to argue that the Constitution does not allow that kind of tax and then have SCOTUS take a second look at it.

The arguments for it being an unconstitutional tax are:

1. It's a tax on something that the Congress is not allowed to do.

2. It's a coercive contract, that is, it's a mandate that is hiding as a tax because of the prison penalty for failing to pay the tax.

3. It violates the 8th amendment protection against excessive fines or cruel and unusual punishment. The person has no choice but to comply with mandate by paying the tax. Being thrown in jail for refusing to purchase health care insurance from a private provider is excessive punishment It's cruel and unusual because the costs of jailing someone will far exceed the cost of health care for the person. The prison environment will be a lot less healthy for the person, too.

That’s the deal in Romneyland. Say you lose your job, and are on unemployment for 6 months. When you fill out the certification of insurance for your state taxes, the tax folks notice that you had no health insurance while you were unemployed and they ding you with a penalty that is not a tax although it is all handled by the state tax compliance people.

Naturally you COULD pay $600 a month for COBRA or whatever alternative they offer you in Massachusetts. If you are not poor enough for “free” health insurance, you get fined if you are too poor to pay.

This dim tactic always makes me want to spit. This dimobot says that I am increasing her health care costs... The dims are responsible for making hospitals accept all comers regardless of ability to pay, which does increase the price charged to payers, if health care was really available only to those with a means of paying, the costs would go down.
