Obamacare violates the first amendment.

The first amendment of the constituion of the US:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Because the mandate is now a "tax", and you are forced to pay it if you are alive and breathing and don't pay for insurance, it becomes a tax on breathing. Since it is necessary to breathe to be alive, it is a tax on being alive. And since you have to be alive to enjoy speech and the exercise of your religion, it is a tax on both. Since both are protected rights in the constitution, it is a tax on two rights protected by the constitution of the US. Period. It is, therefore, unconstitutional.

Forcing a person to pay a tax, simply because they are alive, is a tax on all their rights protected by the constitution. This makes it unconstitutional.

Technically, a person could be jailed by the IRS simply for being alive.

It also violates the legal requirement of due process, specifically substantive due process, and it also violates the basic requirements of contract law, since any health policy you purchase (a contract) was entered into under duress (pain of penalty or imprisonment).

So, I’m wondering how much weight this argument would have when the first person sues, assuming Obamacare is still a law and the country even still exists by then.

I gotta admit it would be interesting to see what happens to the country in the next four years if Obama actually wins a second term. But I’d want to watch from “someplace else”.

I find King Obama’s 1,200 WAIVERS the most egregious and ILLEGAL aspect of this whole thing. How can he unilaterally dictate who pays a tax and who doesn’t, based on his own personal view? And IF the President has a RIGHT to issue waivers, THEN I EXPECT TO SEE THIS HEADLINE IN 2013: “PRESIDENT ROMNEY ISSUES AN OBAMACARE WAIVER TO ALL AMERICANS”.

The people who took oath of offices to enforce laws and the Constitution will not enforce the laws. There are no checks and balances. Who will enforce the law?

Yeah. If I were not a Christian I’d be dangerous. But I am so I’m not. And the reason is what my Christianity teaches me about this world. And since I really do see it as a form of “the Matrix”, it’s really hard for me to take stuff like this all that seriously, even when it directly affects me.

I know how the movie ends.

The govt. has the right to tax you for anything that is what the Supremes decided yesterday you may not like it so what as far as the Supremes & Congress is concerned.

Just be thankful you are not a Jew in 1939 Germany, or a citizen of so many of the east Asian countries in the 1970’s.

Etc.

We had a good run, but no system lasts forever. It is prudent to prepare for a future not related to past experience though.

To be fair, I still think it is better than a 50% chance that Roberts found the proverbial horse head in his bed.

I learned, back in the early 80’s when I sold commercial real estate, that the more money and power is involved in a deal, the more unethical behavior people will justify. This is the biggest money/power grab in the history of mankind.

Anything is possible. Yes, I mean anything. In fact, it is not just possible. It is probable.

Laws can ONLY be enforced when you elect people into our government who CAN’T hide behind race cards and are therefore accountable for their actions. The ‘race card’ killed America because it obliterated accountability.

Roberts didn’t object to this, so Romney can issue a 50 state exemption : )

It kind of reminds me of that scene at the end of Rollerball when one coach is trying to figure out how to deal with the unconscionable rule changes and how they can still win the game. The coach yells at him: “GAME?! THIS WAS NEVER MEANT TO BE A GAME!

IOW, this is not what we naive Americans think it is. We are playing by the wrong rules. We really can’t win. This will not be decided in the courts or the voting booth. Ultimately it will be decided by God, Himself. It’s why I moved to central, Rural KY in August of 2011 to the farm we bought two weeks before Obama was elected.

If you are in a city, you need to be out of there as soon as possible. Yes. I take this that seriously. On it’s own this would be a travesty. But in the current world environment, it runs a very high risk of being the straw that broke the camel’s back. This is especially true if, horror of horrors, Obama wins in November.

I didn't read Roberts' opinion in full. Did he specifically address a president's issuance of waivers? Romney needs to ride the OBAMACARETAX WAIVER horse all the way to his inauguration speech.

"PRESIDENT ROMNEY ISSUES 50 STATE WAIVER TO OBAMACARETAX"

C'mon FReepers, we need to beat this drum relentlessly.
