This just in: As of today, the President's Health Care bill will no longer be known as ObamaCare. Since the President did not ask the Court to change the Mandate from the Commerce Clause to a Tax, but, Chief Justice Roberts made that decision on his on in order to let the bill stand, as of today, it will now be referred to as............. ...............JudgeRobertsCare.

An activist Judge is not one whose rulings we disagree with - it is one who substantially rewrites or reinterprets the law in order to arrive at desired outcomes rather than following the law and precedent.
Roberts didn't rewrite or reinterpret the law - AND he directly said it was NOT his duty to protect people from the consequences of their political choices.
An activist Judge would think that he had to rule on if it was a good law that would derive benefits irrespective of the political choices of the people.
You really need to define your terms here, or do you just use words with “buzz”, without imparting upon them any particular meaning?
THE SUPREME OBAMA TAX
So what I understand...
The Federal Government by law now requires a state to provide education, emergency care to anyone living within it.
The Federal Government has ordered that state cannot do anything to protect itself from outside invaders or to defend immigration laws.
The President may now declare any unlawful person living in that state to have the same rights as a US citizen. One of these rights now includes receiving health care paid by the citizens of that state.
Taxes no longer need to originate by the House of Representatives, and any unconstitutional bill and now be made constitutional just be calling it a tax.
I think all of the piling on to Chief Justice Roberts here today is intellectually weak and tactically misguided.
Obamacare is bad policy. We need to repeal it.
The means to repeal Obama care will be at our fingertips in four short months.
Hating on John Roberts will not help us win the election.
Opposing Obamacare and opposing Obama will.

This gambit of Roberts reminds me of the victim in a murder mystery where he scrawls out some words in his own blood before he expires. The CJ was under unreal pressure. Maybe even credible death threats. So he gave Bambi what he wanted but scrawled across history: “Obamacare is a TAX!”.
This will sink the mighty One for sure. Largest tax in history, which he promised he’d never do, especially to middle class, and he cannot claim it is not a tax because the freakin US Supremes said it WAS. Love it.

And why not? He went above and beyond what he was supposed to do in ruling the Commerce Clause Unconstitutional. HE, not Obama, decided to make it a TAX instead. This was his gift to Obama and the Leftist regime in the White House. This is now his bill.

See my Post #17. He was asked to rule on the Commerce Clause aspect. No one asked him to take it upon himself to say: “But, we can call this a ‘Tax’ and let the Law stand.” And that is exactly what he did. If that isn’t activism, I don’t know what is. Tell me where I’m wrong here.
