As legal scholars study the Supreme Court's decision in the Obamacare case, more and more are concluding that Justice Anthony Kennedy's dissenting opinion, striking down the law in its entirety, was once the majority opinion--and that Chief Justice John Roberts switched his vote at a late stage. If so, it would appear that the Chief Justice may have succumbed to the bullying meted out by President Barack Obama, who attacked the Court in the aftermath of oral arguments in March, when Obamacare seemed headed for certain defeat.

I give him a bit more credit than that. He’s voted conservative the vast majority of the time, and doesn’t strike me as a big social butterfly.
I think doing this pained the guy, which is why it’s worth even talking about right now. The comment that he didn’t think the court needed to be cleaning up the mess that that the legislature created seems like it could be closer to the mark.

I am not optimistic. Boehner and McConnell run anywhere from useless to being part of the problem.
A number of FReepers see this as a blessing. I dont. Romney strikes me as Caspar Milquetoast,and if he loses, I see the country going to hell in a hand basket. It is already over 50% there.

They’ve had him by the short hairs since the multiple swearing ins of the usurper. Just what happened behind those closed doors? Whatever it was, it was intentional that he be a party of it and now they own him.
Then he is saying that the Supreme Court has no purpose. Congress passes a Slavery Act again? Not our problem to fix, you voted for them!
I recall a lot of reasoned commentary here at the time that that suggested the fix was in.
Maybe Valerie Jarret had something on him, and had him by the “short & curlys.”

Like it's ideological FDR ancestor, this thuggish regime knows how to get its way.
That would have been an idle threat, as you can't create additional judgeships without an act of Congress, which requires House approval. You could not get something like that through Harry Reid's Senate, as too many of them are up for election, and it could be filibustered. So, that is not it.
Roberts just caved. It takes a special kind of bull-headed stubbornness to not give in eventually to the DC establishment. Thank God for people like Scalia, Thomas and (so far) Alito. What's interesting is that Kennedy is getting MORE conservative. I think O'Connor was the main reason he kept turning, and with her gone, Scalia has more influence with him.
