Would those waivers really hold now since it is a tax? How could just some businesses/organizations be exempted?

You type faster than I do. That was one of the first things I thought about. Well, not really in the first dozen but I eventually got around to it.
I called my congress critter and inquired. I only talked to a low level staffer but they seemed to think it was a worthy line of inquiry and I'd encourage everybody to talk it up.

Early june 2011 (document dump Friday) Obama stopped allowing new waivers as of 09/2011.
All waivers were always to end at the end of 2013.
