Those Fast and Furious Documents Must be Dynamite (Obama Has Painted Himself Into a Corner)

My friend Bill Otis was a Justice Department lawyer for many years. He spent a good portion of those years as a prosecutor. He also served as an attorney in the White House Counsel’s shop, so he knows all about dealing with unpleasant congressional investigations and demands for documents.

In short, Bill is extremely very well positioned to comment knowledgably on the dispute between Rep. Issa’s Committee and Eric Holder, and on the White House’s decision to assert executive privilege. Here is what Bill had to say:

Even with his fawning press, [Presdient Obama] will pay a price for this one. He knows this, meaning that the documents now to be withheld must be dynamite. They have to show either that Holder knew what was going on with Fast and Furious and approved it, or that he directly committed perjury in his Congressional testimony, or both. I just can’t see any other explanation for such a risky move.

Wasn’t the Washington Post just covering big time the 40th anniversary of Watergate? I wonder how much coverage this one will get.

UPDATE: Some have speculated that Obama’s intervention means that the president himself has something to hide.

Romney has called for one, good on him. Lieberman has called it for it. Obama appointed two and they've been doing a really bang-up job (clearing throat, long and hard) but it's time for the political hacks to step aside and involve some real lawyers. As for Nobama painting himself into a corner by claiming Executive Privilege I have to disagree with the article. Nobama knows that his claim will be challenged in court. There is no way the court will rule on any challenge before the election. Nobama is banking on getting reelected, then dealing with Fast & Furious. I figure that January 25 or so, someone will bring up F&F, then Nobama will simply state that everything had been answered before the election and only an idiot or racist would bother questioning him at that point. Case Closed!

He is not well-informed then. In U.S. vs Nixon, Judge Sirica rendered his decision that Nixon should surrender the tapes on May 31. The deciusion was appealed to SCOTUS on July 8...and their decision was handed down less than three weeks later.

The court can move expeditiously...when it needs to.
