The tribes sued, and the 10th U.S. Circuit Court of Appeals in Denver said the money must be fully reimbursed.
Sure!...What the hell?...It’s only taxpayer money!

White men spoke with forked tongue. So Indian tribes forked white men right back at SCOTUS.

If the feds were actually following Const. Art 1, Sect 8, the reimbursals, if any, would be limited to what the govt was doing, which would be limited. Just another consequence of the living and breathing constitution, unmoored from its foundings.

Seems to me they were owed. Wouldn’t be the first time the government reneged on an agreement with the natives..

Looks like Thomas was the swing vote on this one.

the taxpayers have been giving the Tribes millions upon millions for many, many years. They should all be multimillionaires living in palaces by now.

Justice Sonia Sotomayor wrote the majority opinion for Justices Antonin Scalia, Anthony Kennedy, Clarence Thomas and Elena Kagan. Chief Justice John Roberts, and Justices Ruth Bader Ginsburg, Stephen Breyer and Samuel Alito dissented. Wow, that is a strange breakdown! 2 Libs 2 Conservatives 1 Moderate in the majority and 2 Libs 2 Conservatives in the minority. You don't see that very often!

next lawsuit --> U.S. government f'd up their online cigarette businesses when passing the law that no cigarettes could be sent through the U.S. mail.
the tribes will be sympathetic because Congress actually passed a law which interferred in commerce (their livelihood) (remember: Congress shall pass no law which interferes ... )

Justice Sonia Sotomayor wrote the majority opinion for Justices Antonin Scalia, Anthony Kennedy, Clarence Thomas and Elena Kagan. Chief Justice John Roberts, and Justices Ruth Bader Ginsburg, Stephen Breyer and Samuel Alito dissented. That is some mixture of justices on both sides.

Why are we giving them any money anymore? They always claim sovereign nation status on their reservation land. Besides they make oodles of money on their casinos.
