A jury in Gwinnett County, Ga., has awarded $3 million to the widow of an Atlanta police officer who died while having three-way sex, finding that his doctor was negligent in not properly diagnosing and treating his heart condition.

We already know the cop was a total a$$hole. He disregarded the conventions of society in having a 3way with some woman he wasn’t even married to. he showed that he wasn’t going to follow societal stictures “I’m a cop, I can do anything I want.” I think we can also assume that he would have disregarded any medical advice regarding strenuous activity in this regard also. It was the ahole’s responsibility. You don’t go to the doctor and leave with the guarantee that you will never die. People die. This award is a travesty and I hope it’s overturned on appeal.

No, I don’t think so. It is not as if this was a wrongful death caused by someone else’s negligence; the deceased died a disgraceful death while willingly engaged in despicable behavior.

The jury believes there was no evidence the cardiologist gave such advice. That's all that matters.

Folks go to the doc to obtain competent medical services. That includes competent scientific evaluation and precautionary advice. The doc in this case was sued and found at fault, because he provided evidence that he was incompetent, negligent and that resulted in harm to the patient and the patient's family.
It's business. When you're engaged in business, you're responsible for your failings. Everything else is irrelevant.

Juries are notorious for awarding cash where they shouldn't. Remember the idiot who successfully sued MacDonalds because she spilled hot coffee on herself? It is just another example of juries working on the envy principle and sticking it to someone whom they perceive to be better/richer than them - a doctor. John Edwards made a fortune on this paradigm. The guy's widow doesn't deserve a penny.
Your analysis is based on irrelevant anecdotes and has no bearing on this case. The cardiologist was negligent and failed to provide the proffesional services promised. That’s all that matters.
I'm in no way trying to justify his actions nor the verdict. I was addressing the mans widow....my opinion is, yes, you were humiliated and shamed.....but you don't turn down the 3 million because it is humiliating to take it.

Morally, Martinez was perhaps 25% responsible for his own death. The other man in bed with him and the woman were also 25% responsible each. The doctor's responsibility? Not even 1% based on what I have read in a number of articles, including the explanations by the plaintiff's lawyer in this completely frivolous case. Where does the last 25% of the blame go? To the disgusting wife who is suing over his death. I doubt that this is the first time she has behaved in such a revolting, money-grubbing manner. I can completely understand this guy wanting companionship other than his wife if she normally behaved in so pathetic a manner. I just wish he had the decency to divorce her first - and to wait until after the tests that his doctor ordered.
Parasites like this lawyer and the (apparently not grieving) widow disgust me. Decent people pay far more for medical care and for medical insurance to support evil, immoral women like the wife in this case, and to enrich sleazy lawyers like this plaintiff's lawyer. I have no objection to those who produce something of value making a generous living, but to use the courts to enrich those who harm America (and most tort lawyers fall into that category, by definition) offends me.

Admittedly, I did not read the entire post, but I am assuming that the widow is the one who brought the suit. So she is the one who came forward and said that she wanted compensation for the degenerate’s death.
The services cardiologists are supposed to provide! The patient presented with symptoms consistent with significant blockage to a cardiologist! If the stress test wasn't given immediately, he should have been given orders for no exertion. This guy could have went home and died playing catch with his kids.

Unless you were either present during the examination or read the physician's notes you have no idea what was said. You are ASSUMING something to support your interpretation of events, but you're SPECULATING.

First with significant blockage a stress stest is not always indicated. In fact it might be a bad idea. I had a relative who went with symptoms of blockaage and was given an appointment with the cath lab. The operative word here is appointment. All of these tests have to be scheduled. So unless you are a cardiologist and know for a fact that the jerk was NOT given instructions to avoid strenuous activity, then you're just blowing pink smoke to support your opinion.
My opinion is that the ahole engaged in risky behavior and paid the consequences. I had another relative who went to a cardiologist was given the diagnosis of ischemic heart disease and was scheduled for further tests later. Died from a massive heat attack a couple of days later. Was this the cardiologist's fault? of course not
The modern trend is to want to blame someone, anyone except the responsible party for bad things that happen. You die, it's the doctor's fault. You get AIDS, it's society's fault. You spill hot coffee on yourself it's MacDonalds fault. You get robbed it's the NRA's fault. Teenagers kill someone in a car crash? It's the parent's fault.
Sorry good buddy. I just don't buy it. Individuals are responsible for their actions and should bear the consequences. Considering that individual responsibility is considered a conservative philosophy, I'm mildly surprised that you are espousing the opposite view on what is nominally a conservative forum.
