The night Obama was elected was one of the most depressing night of most of our lives.

That is true, but it was not all ice cream and lollypops here either. People were very upset and even demanded that the results were not true and that the Democrats stole it....it was not a pretty night around Free Republic. However, we did keep it amongst ourselves.

Yes, but at the state level what we witnessed last night is the essence of Democracy in action, whch of course is too complicated for the dead soul unionists who are herded at the will of their masters.

I suggest that this fellow seek out Mickey Mouse and Adolf Hitler and continue to have a good cry with them. They didn’t get the results they wanted either.

Only the office of the President is elected by the Electoral College. All others are elected democratically. We live in a democratic republic. Our government is a republican form of government. Our elections are democratic.

Our founders knew history and philosophy. They knew that a pure democracy was one of the worst forms of government because it culminates in mob rule and anarchy. Still some sense of people deciding who will represent them was essential.

On the other hand a government must secure and protect rights. The most successful form of government that can accomplish this is a ‘republic’. Re-Public connotes ‘rule of law’.

I construe the liberal lamenting about ‘losing our democracy’ was in fact meaning ‘losing our power within the democratic election process’. Surely the democratic aspect of elections is not at all lost. So the lament was simply loser talk.

My question: If THE NINE SUPREMES have democratic veto power over ‘the rule of law,’ (commonly by a 5 to 4 vote), then, in the final analysis, are indeed a Representative Republic, or even a Republic?

The Supreme Court is essential to maintaining the rule of law as embodied in the US Constitution. Hence, they represent the guardians of the republic.

In order to preserve the spirit of our rule of law there can be no other body politic other than the Supreme Court.

There are many designs of rule of law. To prevent our constitutional rule of law from morphing into a form that seems alien to the original design, there must be a body separate from the Congress and separate from the Presidency that impedes such morphing. I say ‘impede’ and not prevent because Congress can always override the Supreme Court by Amendment and the People can always override Congress by State Conventions.

The Founders were very wise indeed in designing our system of government. Like a machine with fault tolerance they anticipated how human nature has a tendency to create tyranny when there is nothing to curb this tendency, so the structures and powers were designed to diffuse power and provide backup means to address grievances.

But the Founders could not design away one possible flaw in the entire system and that is the nature of the electorate. They put ultimate power in the People. If the People want communism, they get communism. If the People want Obamacare, they get Obamacare because even if it is struck down by the Supremes the People have the power to amend the Constitution.

John Adams had it right in that the survival of the Republic depended on the moral character of its people:

“Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other.”
