Wis. gov signs bill erasing discrimination damages

MADISON, Wis. (AP) Wisconsin Gov. Scott Walker has signed a bill that prohibits workers from collecting damages in employment discrimination cases.
Under current state law, employees who prevail in discrimination lawsuits can collect between $50,000 and $300,000 in compensatory and punitive damages. The Republican bill blocks anyone from collecting such damages in employment discrimination suits.

So now it’s essentially legal to discriminate — if you’re caught, all you have to do is pay backpay? I’m not following...

So if your boss has been an ass you can still get what you deserved without getting more for your hurt feelings. This might stop a lot of false claims.

Another step in the defunding of the Left. Employment discrimination awards form a huge pool of cash for trial lawyers, some of which gets recycled back to Dem politicians via campaign contributions. This will break the cycle, at least in Wisconsin.
I think the point is that you can fire someone who isn’t doing his job, and not get sued for big bucks because the guy who was sitting around doing nothing is a member of a designated victim class.
Good! The public union employees are already overpaid as it is.
Takes away the incentive for frivolous litigation. Those who produce, earnest seek a good day’s work for good pay and actually show up *cough* Keith Olbermann *cough* have no need for such stupid litiguousness.

The AP is reporting on this law. I am willing to presume this law is not as simplisitic as reported.
The problem is that this also takes away an incentive not to violate the law. Under this provision, if an employer breaks the law, the worst that can happen to them is that they are ordered to pay back pay (in other words, to pay the employee what they would have paid had they not broken the law) - and that only happens if the employee sues and wins. Damages awards, in this kind of case, serve as a deterrent.
Think of shoplifting as an example - if the penalty for shoplifting were simply to pay for the items stolen, shoplifting rates would skyrocket, because the worst-case cost if caught breaking the law would be no worse than the cost of complying with the law.
Obviously, not. There are no damages from discrimination other than back-pay (and let's not forget the fines.) Are you really of the belief that I can put a monetary value on feeling really, really bad that I didn't get a job because I was discriminated against?
The entire concept of damages for pain-and-suffering is a despicable invention of the American legal industry and I'm glad to see it starting to be outlawed. I suppose now the tort lawyers will sue for damages because they can't sue for damages.
