While Solicitor General Donald Verrilli, Jr. made the Obama administrations case for the constitutionality of the individual mandate in the health-care law Tuesday, Supreme Court Justice Antonin Scalia interrupted, telling Verrilli, were not stupid.
Justice Elena Kagan, a former solicitor general appointed by President Obama to the high court, sided with Verilli in arguing that young people should be required by the federal government to purchase health insurance because eventually, others will subsidize their health care in the future.
Scalia shot back, arguing that young people will make the decision to buy health insurance eventually and do not need to be forced by the federal government to engage in commerce.

What was Kagan allowed on the court? What a joke.
Depends on whom Justice Scalia meant by “we”; Justice Kagan is absolutely stupid-in-the-bag for the Obamanation.

Let Kagan sit through this case then impeach her sorry unqualified rear out of there. Wait until after the election. Hopefully, we have enough Senators and a Republican president and we can get a qualified conservative Justice.

Using the same logic, the government could ban cigars, high calorie drinks, high fat meals, you name it. Nothing is off limits.

She doesn’t give one crap what the Constitution says or means, and she isn’t even pretending in that comment.
That is the whole idea....total control over the population.....we are almost there, anyway. If SCOTUS upholds Obamacare, we ARE there!
I highly doubt Kagan even believes in the Constitution. She has an anthropologist’s view of it - she studies it as a window how a former society organized itself, but leftists like her feel they are well beyond it.
She is Obama’s land-mine to America which will keep spreading her error for decades to come.
