There are two conflicting sets of problems here.
The first is a transgender who identifies as a male. The second is the other dorm residents who may feel uncomfortable with a transgender person who is allowed intimate access to their lives.
It shouldn’t be a problem. That is, the university no doubt has many jobs equivalent to a dorm resident assistant they could offer this person, that are in no way dependent on, or sensitive to gender.
While the law may say that this person cannot be discriminated against as far as being hired, at a particular pay level and grade, they law should in no way force either employment that makes someone sexually uncomfortable, or makes others sexually uncomfortable, in intimate surroundings.
There is an exception to jobs that require some degree of sexual intimacy, that they may be specific to a gender. But there is no legitimate way in which the law can require an employer to impose what is in effect sexual harassment, on its customers, based on the *desire* of a potential employee to have that particular job.
This reminds me of my favorite poet, Samuel Hoffenstein, who wrote: “Breathes there a man with hide so tough, Who says two sexes aren’t enough?”
And I identify myself as a multi-millionaire....
What happens when a person who was born a man, and identifies himself as a man, attempts to have sex with this person based on the fact that she is biologically female? Suppose they’re all drunk and he succeeds? Or what if a man who identifies himself as homosexual attempts to have sex with this person based on her identifying herself as male, only to find that he’s a she?
I’m very grateful that all the people in my life are, in fact, the sex they think they are.
