Deportation rules breaking up families
San Antonio Express ^ | March 18, 2012 | Esther J. Cepeda, Washington Post columnist

Wasteful, senseless and cruel. How better to describe the ridiculous battle that Felipe Montes is waging to be reunited with his three U.S.-born children? Since his deportation, they've been ensnared by the foster care system and are at risk of being put up for adoption.

Montes, who had lived in the U.S. illegally for almost 10 years, was sent back to Mexico in 2010 after having been sentenced to probation following an arrest for driving with an expired license, an expired registration and no automobile insurance. He was detained by Immigration and Customs Enforcement (ICE) agents at one of his probation meetings.

Under normal circumstances, Montes' children would have been put in the care of a relative. But since there was no relative capable of caring for them, social workers took his boys, all under the age of 7, and separated them into different foster families. Now the state of North Carolina won't let Montes claim his children just because he's in Mexico.

According to an Associated Press report, ICE officials said they didn't communicate with North Carolina's Child Protective Services about Montes because it's not their job to call child welfare officials every time a parent is detained.

“driving with an expired license, an expired registration and no automobile insurance.”

legal or Illegal, he has crossed into the area I support the death penalty for!

The biggest part of my auto insurance is “uninsured motorist.” People drive with no insurance, no license - and little or no worry when they are caught. This guy got sent back to Mexico - big deal.

The laws don’t say that illegal immigrants children are Americans......only the “interpretation” of the law is sustained.

Deportations occur around the world, in over a hundred countries, day in and day out, and as I speak. Right now, some man is being separated from his wife or kids, somewhere in an immigration office or at an airport or port.

Because HE ENTERED THAT COUNTRY ILLEGALLY.

The US should get over this point. Actions have consequences.

IMHO, the issue here is NOT the deportation. The deportation seems perfectly justified. The issue is the HOLDING of the children, i.e. not letting them leave to be with their father.

Keeping people OUT OF your country has a long and valid history. Keeping people IN your country, against their wishes(or the wishes of their parent, in this case) also has a long history, but not a history to support.

And maybe if my aunt had a mustache she’d be my uncle. Tough sh!t for the illegals and their kids. As every other American, I’m sick of this bs. You break the law, you pay for it.

I suspect he’s just astonished that he has three `anchor baby’ cards but he’s not hitting `21’ on any of them. The next step is usually to find a state or US critter to make an impassioned plea on his behalf but he may have tried this route already as well.
All we’re hearing is what the San Antonio/Wash. Post’s Esther Cepeda tells us, and a lot of the article is yellow journailsm/purple prose.
For ex. he may be an unfit father, for all we know, but they’re American citizens, right? At least that’s what they tell us. But he’s not. Hasta lluego Felipe.

Re your post #9, when you see that the author is associated with The Washington Post you can be assured that the premise of the piece will be U.S. laws BAD, poor Mexicans GOOD. It’s what that excuse for a newspaper specializes in.

I have never understood why they don’t ship the entire family back at the same time. Save us millions of dollars. So stupid.

Let’s help Mr Montes - and eliminate the disgrace called “birthright citizenship”. Then his 3 kids can live with him in Mexico, where they belong.

Criminals always have to leave their families when they break the law and go to prison.

Illegal ailens have it much better, they can take their families with them if they choose.

I think it is a great idea to be tough on them, to let others rethink coming here illegally.

We have a legal system of immigration just so stuff like this does not happen. Legal is good for us and it is good for immigrants.

“They would be welcome in Mexico. They apparently have a father who wants them in Mexico. The problem (according to the story) is that the State of North Carolina is not letting them go to Mexico, and is distributing them to its own agents (”foster parents”) and planning to put them up for adoption to strangers instead of letting them go to their father. Apparently, there is not even an allegation of child abuse. Seriously ... on a basic human level, this is just sick.”

Something is really wrong in North Carolina. First they seem to think it’s o.k. to take a four year olds family-prepared lunch away from her, and now this.
