Judges orders millions paid in NYC firefighter bias case

(CNN) -- A U.S. district judge ordered New York City to pay $128 million in to firefighters who allege the city used an entrance exam that deliberately sought to keep African-Americans and Latino Americans off the force. The judge also ordered the FDNY to hire 293 black and Latino applicants.

"It has been in the city's power to prevent or remedy the need for damages proceedings for a decade, and it has not done so," U.S. District Judge Nicholas G. Garufis said in his ruling on the class action lawsuit. He called it the "consequences of the city's decision to ignore clear violations of federal law."

The federal government had sued the city (United States of America and Vulcan Society Inc. vs. City of New York) alleging the city violated the U.S. Constitution and local civil rights laws by using an entrance exam intentionally designed to discriminate based on race.

The lawsuit alleged that the exams had little to do with firefighting and instead focused on cognitive and reading skills. Because of the hereditary nature of the fire department, white candidates were recruited and supported throughout the application process by family or neighborhood contacts and whites consistently passed while minority candidates failed.

I don't understand how they could make an entrance test passable by a dumber white guy but not by a smarter black man.

If the good judge had the common sense that God gave gravel, he'd realize that the blame for the blacks not passing the reading portion of the exam likely lies with the public screwls, and therefore with the racist Dems.

I figured it was the questions about NASCAR and the NHL that was the problem, but it seems there wasn’t any.

You can’t. Regardless of what these liberal judges believe and how they rule, tests cannot be formulated to favor the less intelligent of one race over the more intelligent of another race. 1+1=2, the first preident of the United States was George Washington, combine one part oxygen and two of hydrogen, and you get water. History, science, basic and advanced mathematics are all blind to color. This judge is wrong. The Almighty help the residents of NYC if a fire breaks out and the responders are second-rate, affirmative action fire fighters.

This happened at one of my duty stations. An applicant for a civilian position filed a racial discrimination suit against the government. He claims he was not hired because he was black. The hiring authority was white but his whole section was black/hispanic.

The funny thing about it is most federal jobs (Department Of Defense) don't do face to face interviews. The hiring authority only gets your resume and relevant documents for the position. They then grade them and pick the best of three. The HR folks track race, gender, etc but they don't do the hiring.

Seeing this is from the Clinton News Network, pretty amazing (in a good way) the comments. This SHOULD be appealed and go all the way up the Judicial system.

Common sense doesn’t enter into it. As long as you can show a racial disparity in the results, then the test is going to be considered unfair and discriminatory. The problem is that just about any test will show such a disparity. So, ultimately, you’ll just have to hire people based on their race.

Seriously? The tests are objective so that only “the most qualified” are hired? Make me laugh. Fire departments ARE hotbeds of father-to-son hiring.

So are all cushy well-paid government union jobs.

If I were an outsider and wanted a piece of that action, I’d sue, too.

I feel sorry for myself — as a taxpayer who ultimately foots the bill for this nonsense. But I don’t blame the guys who want in.

The insular government union culture has GOT to go, or this country is doomed.
