Rocklin [California] Considering Banning Residents From Smoking Outside Their Own Homes

ROCKLIN (CBS13) – A Placer County town is considering a ban on smoking that some say goes way too far.

The Rocklin City Council is considering making it against the law for smokers to smoke anywhere outside on their property.

The city council is considering the ban after one home owner complained about smoke coming from their neighbors’ backyards saying it caused health problems for their kids.

But before going to the city council, the family first asked their neighbors to stop smoking.

One couple agreed, according to their son.

“They felt that there wasn’t any reason to put the household in any sort of health risk,” Eric Croslin said explaining his parent’s position.

But some smokers and even some non-smokers saying this ban goes too far.

“So what about people who have children in their home and they don’t want to smoke in their home?” asked non-smoker Tamara Davis.

“As a smoker, I think that smokers should be considerate,” said Rocklin resident and smoker Ryan Malonson. “But on your own property, that’s unacceptable…It’s not going to pass.”

It is already against the law for smokers to light up near businesses, parks and playground in California.

Still the non-smokers have at least one automobile ~ and that exhaust is far nastier than that of tobacco ~ and they probably barbaque meat outdoors from time to time (or at least roast veggies).

Wonder what they'd think if someone complained to the city council about the grill, the car, the stove, the toilet vent, the..... well, maybe SWEATY BODIES.

I am an ex-smoker and when I go out in my backyard and the neighbor is smoking his cigar, it makes me sick. It smells horrible. I have a fan I bring out and blow it back his way. It helps some. Banning someone in their own yard is going way to far though.

I was thinking similarly. I think the Solomon Solution would be to have the smokers smoke in their garage with the door down and have the non-smoker do likewise when he's warming up his car.

Rocklin is actually a very conservative town. It is in Placer County which overwhelmingly votes Republican. However, there has been an influx of some Bay Area transplants into this area over the years. Although there are a few liberal pockets here and there, it is not the norm for Rocklin. Hopefully, the city council understands that their residents would, for the most part, be appalled by such a restriction of freedom.

How is that any different than standing in your doorway blowing smoke toward your neighbors?

The complainers here are not “non-smokers” they are ANTI-smokers, and entirely different breed. Non-smokers are willing to work with smokers, anti-smokers are just plain intolerant and have a my way or the highway attitude regardless of what accommodations are made to them.

The Rocklin City Council is considering making it against the law for smokers to smoke anywhere outside on their property.

This goes right along with the (smoker-financed) California anti-smoking TV propaganda commercials. The multi-billion$ tobacco settlement of a couple of decades ago had specific goals that have been ignored. One of them was "Education," but another was funding of health care expenses for smoking related diseases.

To date, I have not seen a single accounting of how the money is being spent in California, other than the rumor that funds have been diverted (like many other funds have been) to the State General Fund.

Local ordinances, like this proposed one in Rocklin, fail utterly to justify the restriction of others' basic citizenship rights with scientific proof, and rely on apocryphal rumors and personal dislikes. If simply a minuscule whiff of an unwanted odor is cause to restrict the rights of others, it isn't simply a matter of a "slippery slope;" it is a wholesale flood.

It is evidence of a serious personality neurotic disorder.

I once had a hysterical woman run 50 yards to yell at me for endangering her lungs, and all her progenies' for five generations...

When I lit a cigarette downwind of her (and everyone else.)

I have also received, on many occasions, a ballistic hissy fit from women, mostly, although men are not immune, in department stores when I walked around with a plastic pen that was in the shape of a filter cigarette in my mouth.

"Of all tyrannies, a tyranny exercised for the good of its victims may be the most oppressive. It may be better to live under robber barons than under omnipotent moral busybodies. The robber baron's cruelty may sometimes sleep, his cupidity may at some point be satiated; but those who torment us for our own good will torment us without end, for they do so with the approval of their consciences.” -- C. S. Lewis
