Overreach: Obamacare vs. the Constitution (Obama wins the birth control mandate issue!)

Give him points for cleverness. President Obama’s birth control “accommodation” was as politically successful as it was morally meaningless. It was nothing but an accounting trick that still forces Catholic (and other religious) institutions to provide medical insurance that guarantees free birth control, tubal ligation and morning-after abortifacients — all of which violate church doctrine on the sanctity of life.

The trick is that these birth control/abortion services will supposedly be provided independently and free of charge by the religious institution’s insurance company. But this changes none of the moral calculus. Holy Cross Hospital, for example, is still required by law to engage an insurance company that is required by law to provide these doctrinally proscribed services to all Holy Cross employees.

How the h*** did Obama win an issue that should have rocked him back in his chair? Is his opposition so weak and cowardly that he wins again by destroying the First Amendment? What's next? And who will stop him? Santorum? Romney? Paul? A brokered convention? I watched in stunned belief as far-Left congresspeople stormed out of a congressional hearing on birth control in self-righteous, utterly hypocritical indignation and the Repubs let them get away with it. Is 2012 going to be a repeat of 1992?

Obama just declares victory and moves on. I don’t think he has been challenged on this yet. I think victory is a bit much when the game hasn’t started yet.

The religious community has called bullshit imediately, but the GOP is A-f*ing-WOL, as usual. And the media of course won't present the religous viewpoint as anything other than an attempt to deprive women of their "rights.".

1000%....this issue is far from over and will cost obama dearly....

the Christian community and even a portion of the Jewish community is justifiably in an uproar and its only going to get louder....

of course it was their faux pas to begin with thinking that a POS who would not take a stand against live birth abortion and has always been for publicly funded abortions would somehow put forth legislation that would not encourage the murder of innocents or the rely on personal responsibility when it came to sex...

50% of people polled recently are against dear leaders “accommodation”...its only going to get worse for him, just like the % of people that want this sh!t health law repealed is going to explode...

This morning during a live interview a reporter for KNX radio(Los Angeles) tried to trap Newt Gingrich by asking “If you are president and legislation outlawing contraception reaches your desk will you sign it?” Gingrich handled it well. He said that it would never happen. He said people in Southern California and concerned about high gas prices and unemployment. Gingrich did not take the bait. The reporter was so mad. All he could say was “Why won’t you answer the question!?

In reading the comments at the article I see someone mentions the obligatory pedophile predators. It is strange to me that this is always used to discredit anything Catholic, but nobody mentions the pedophile teachers in order to discredit public education. Perhaps we ought.

The American people LOVE fornication (and pornography), they can't get enough of either one.

Unlimited access to female contraception is the necessary precondition to the American fornication utopia, and Obama knows it.

Having a candidate bring this up as an issue was of course a godsend for Axelrod, but he would have done this anyway, just to get on the right side of the sex question.

The same is true of homosexual "marriage". Gay rights is just a proxy for f*** who you want, how you want, when and where you want.

Both of these are big Democrat issues, and are winners for Zero.

Politicians forcing employers to give specific voters special goodies for free while claiming it cost nothing to anyone, and claiming it's part of those specific voters ‘civil’ rights as a health issue is a very powerful political lure to get votes.

Besides all the child-bearing-aged women that are giddy that they will get this ‘gift’ free of charge from Obama(most voted for Obama in 2008 anyway, probably are for gay marriage too), you got lots of voters that want those, let us call them 'active' women, to use BC rather than see them on a daytime judge TV show complaining about how their new boyfriends spent their child support on drugs (just talking voters perception here.)

A number of Obama-care supporting Catholic Democrats and Catholic liberal organizations staged/faked outrage over the BC/mandate/Church issue to lure Republicans in, then they quickly bailed at Obama’s cue which was the make believe 'compromise', leaving Republicans and a few Bishops holding the BC bag so to speak. Now Dems have another issue to run on.

It was a trap.

Kraut nails it right here. It is understandable why Romney can’t make the case, which is why he has no business being our nominee, but what is the rest of the party’s excuse? This is one reason I am surprised Santorum wants to avoid the national debate stage. He can nail Obamneycare again, and make the case why it is so important to repeal it. Instead, he chooses to hide. I really don’t get it.

Obamacare is ballgame, and the GOP has dropped the ball.

Wondering for awhile now about Mr. Krauthammer. How can this be called a win when all Obama did was what he has been doing since before he took office, flip the wee birdie.

The Left has people believing that this is about ‘reproductive rights’. Students in Catholic Colleges believe that the Church is trying to force their beliefs on them.
They are clueless about the Constitution. Obama told us he believed the Constitution to be a ‘charter of negative liberties’. So his oath to uphold and defend a Constitution that meant nothing to him was easy.

With Barry's Birth Control DICTATE, supposedly allowed under the power of ObamaCare and 'women's health, IMHO he has went for A Bridge Too Far.
The next thing up his and Kathy Silly-buses sleeve could be that Kosher Food is unhealthy, will add to 'Health Costs', shorten peoples lives, and therefore they have no option except to Ban It. No Kosher Corned Beef, no Pastrami, no Kosher nothing and it must be pulled from the shelves asap. And all Kosher Food companies must close down pdq. Even cooking Kosher Food at home from scratch will be illegal and those found ignoring this Health Regulation will face Fines and Jail.

After that they will find that 'Soul Food' is also dangerous to peoples lives as it contains High Fat ingredients is cooked in life shortening oils like Lard and 'as we know' can cause Heart Attacks. Therefore all Soul Food is banned and all 'Soul Food Cafes' must be closed asap. And anyone caught cooking traditional Soul Food items at home will also face Fines and Jail.

When they get done with the Jews and Blacks, then they'll go after the 'Rednecks' and ALL 'Southern Fried Cooking' will be banned too. And any 'hillbilly' found deep-frying chicken at home will go to Jail.

The next target for Barry and his Health SWAT Teams will be Texans and BBQ. And their Chili too. God only knows what's in it but it can't be 'healthy' so it must be banned too. However Texans will not have to worry about Jail. They'll just be shot on sight.

Ridiculous, you betcha. But if he can DICTATE birth control to Catholics due to 'health reasons', he can dictate ANYTHING to ANYONE under the same bs reasoning.

So this is much much more than about 'Birth Control', it's about freedom.

We're also going to try to replace some of our older servers and failing equipment this year so we're going to add a little extra to our FReepathon goals. John is estimating ten to fifteen thousand to do this and I'd like to get it all in place and working before the election cycle is fully heated up, so we'll try to bring in a little more now if we can and the rest next quarter.

The case is being made by the actions themselves. I believe the individual mandate case before the Supreme Court just got more difficult to defend.

One of the plaintiff's arguments will have to do with the "slippery slope" question, and here we have validation that there really is no end to unintended consequences by virtue of allowing the individual mandate to be upheld.

Secondly, since health care insurance may not be sold across state lines, the commerce clause is no longer valid. Though the prevention of a pregnancy can make the contraceptive mandate cost neutral (I am told by insurance professionals that they believe it will be), this fact is simply irrelevant, and should be actionable under restraint of trade laws, or tenth amendment protections at the very least.

Polls won’t matter, they already gave him the power to do this. Besides the MSM will find a way to twist it and convince enough Americans to change their minds.

Well, right there is where Krautheimer’s analytical skills failed him. The reason that Republicans failed to make the argument is exactly because they are the opposition party. The pushback on Obamacare never came from the Republican party establishment, it came from the grass roots. You can’t expect the party to fight this fight either, since they rarely stick their necks out for what the base cares about.
