(NewsCore) - CHICAGO -- The man who composed Survivor's hit song "Eye of the Tiger" filed a lawsuit against former House Speaker Newt Gingrich in Chicago on Monday in a bid to stop the Republican presidential candidate from using it at campaign events without his permission.
Rude Music Inc., owned by Frank Sullivan who composed and copyrighted the song in 1982, lodged the suit in federal court in Chicago, seeking an injunction against Gingrich, The Chicago Tribune reported.
The suit lists a series of events where Gingrich has used the song made famous by its use in Sylvester Stallone's "Rocky III" to mark his entrance, including appearances at the Conservative Political Action Conference over the past three years and numerous events in the lead-up to the Iowa caucuses.

Song sucked then, and it sucks now. The one-hit-wonder has-been just wants one last shot at being in the spotlight again, after over thirty years of being a one-hit-wonder has-been.

If Newt paid the fee for using the song the composer is completely out of luck. He can’t use it under fair use because that needs to be an insubstantial amount for purposes of parody, education, or criticism.

The real crime here is that someone would dredge up and play that horrid song.
This crap always seems to come up in campaigns. I have a suggestion to all candidates: if you want to claim some popular song as your theme music, why don’t you check with the artist(s) for their opinion before running with it? Not doing so simply opens you to a negative blip in the news cycle when the artist invariably objects.
Second suggestion: avoid “Eye of the Tiger” at all costs. It is an atrocious song.

Sounds good! But don’t rule out Weird Al Yankovic’s “Rocky XIII” The Rye or the Kaiser!

A great movie a great scene and the song fit the moment...and I lived in South Philly where it was filmed..I still get goose bumps...you have to be a under dog from the poor section of South Philly to love it!! JMHO because I lived it!

This is just about a leftist attention whore making a legally untenable claim.
I’m just amazed that news outlets publish this stuff without talking to a competent entertainment lawyer.
In this case, it's rather harmless; I don't think the public has much invested emotion in the composer, let alone the original performers, of "Eye of the Tiger".
But when Reagan ran with "Born in the USA", the news cycle devoured Springsteen's objections with glee. I know Bachmann was burned, as was McCain at some point.
How about a rule: all conservative candidates step to the podium to Nugent's "Stranglehold". At least we can count on the candidate getting hit from the right if at all.
