Homeowner shoots intruder who fled from cops

PORT ORCHARD, Wash. - A homeowner shot and wounded an intruder who burst into his home while running from police early Saturday in Port Orchard, the Washington State Patrol reported.

The drama began when police responded to the area of Melcher Street and Tacoma Avenue at about 1:15 a.m. after receiving a 911 call from someone who hung up on dispatchers, said Krista D. Hedstrom of the State Patrol.

Officers found a 47-year-old man in the street and two officers got into a struggle with him. Police fired a Taser to subdue the man, but it had no effect, Hedstrom said.

At that point, the suspect fled from officers and went to a nearby home. He forced his way inside and got into a confrontation with the homeowner, a man in his 20s.

There was a verbal and physical altercation between the intruder and the homeowner. The homeowner then fired a single shot at the intruder, hitting him in the abdomen, Hedstrom said.

The intruder was taken to St. Joseph's Medical Center in Tacoma, where he is in stable condition.

The homeowner and two officers sustained minor injuries during the incident.

Hedstrom said it does not appear the intruder knew the homeowner or any other occupants of the home. She said officers believe the 47-year-old man was in the neighborhood visiting someone else before the incident, but he does not live in there.

The case remains under investigation, Hedstrom said.

No more likely to be tried for 2 shots then 1.
“Your honor I feared for my life and he kept comming”.

Now if he emptied the magazine and say shot him in the back, thats another story...

Isn’t this a double hit of the lottery in Washington? Because the perp is alive he gets to sue the homeowner for shooting him and the police for chasing him into a dangerous place.

It would be a difficult argument for government to prosecute victim if police were in a physical confrontation and defeated cops. Does state have castle doctrine?

No, it is only wrong to keep shooting after you no linger feel threatened. Two quick shots or even three or four would not be considered unusual.

Well, it said there was a physical confrontation with the intruder and homeowner. In Florida that that is Burglary of an Occupied Dwelling with Person Assaulted. Its a life felony. Given the circumstances, bonus for the homeowner...

You keep shooting - spray and pray style - until the perp is dead. Then you reload and don’t take your eye of him until the cops show up.

Mozambique style would have given him a good dirt nap.

You don’t shoot to stun. You shoot to kill.

Washington

The statute in Washington state appears to be very simply and broadly stated.[26]

The law allows use of deadly force in the lawful defense of oneself, a family member, or any other person, when there is reasonable ground to prevent action(s) of the person slain to commit a felony or to do injury or harm, and there is imminent danger of such design being accomplished; or in the actual resistance of an attempt to commit a felony upon the slayer, on those in their presence, or upon or in a dwelling, or other place of abode, in which they are.

Washington state doesn’t have a specific Castle Doctrine law, but has no duty to retreat as precedent was set when the State Supreme Court found “that there is no duty to retreat when a person is assaulted in a place where he or she has a right to be.”[27][28]

Wow. The two maps differ out west big time.. personally, I don’t care what state im in. I will NOT retreat in my own home.

My German Shepherds would be on the guy before I could get off a shot.They have even less tolerance of intruders than I do.

In some respects, the the law for use of deadly force by private citizens in the State of Washington is broader than in Texas.

The homeowner is in the clear on this one.

The state of Washington didn’t need csatle doctrine law when they became popular for the simple reason is that the laws of State of Washington has always been very favorable towards citizens defending themselves.
