One of the two pre-teen boys charged with dropping a shopping cart over a fourth-story railing in East Harlem -- nearly killing a philanthropist who was shopping for underprivileged kids -- will be sentenced to as little as probation after pleading guilty to felony assault today.
"I held the shopping cart over and I knew people was down there," 12-year-old Jiovianni Rosario said sadly, in admitting his guilt before Family Court Judge Susan Larabee.
"And I knew somebody could have gotten hurt."
Prosecutors say that victim Marion Hedges remains in serious condition from being struck by the cart. Hedge's family agrees with the deal, they said.

Little creeps should be in reform school and their parents should be in jail for at least the next 15 years.
Kid is an idiot.
Family agreeing to the deal are idiots.
What is a little felony assault between friends??
What would Sharia do?
Anyone who has ever thrown a snowball at a moving car could have done as much damage or worse; 12 year-olds are stupid.
People in New York LOVE to complain about criminals walking...yet they ELECT the people that cause it.
Don’t forget, this animal was LAUGHING when he was arrested...I guess he understood the legal system there better than many of us.
do I realy need a sarcasm tag?
There are no longer any reform schools in New York state. The ACLU sued to close them all down. Their argument was the kids would be better off in public schools where they can see how behaved kids should act. The gangs took over the schools.
“Anyone who has ever thrown a snowball at a moving car could have done as much damage or worse...”
Long shot - and so what? This was done with the specific purpose of hurting someone.
Inhuman garbage. And garbage needs to be taken out and incinerated. You leave garbage on the streets of NYC and it will rot and stink and make life for decent people intolerable. Take the garbage out NOW. While you’re at it, there is a huge load of garbage down in Wall Street that needs to be taken out. 120 miles out.
A 30 pound metal snowball dropped from 4 stories?
Now that is an insane comment.
I have no problem with them throwing the kid into prison for life; I just know that there but for the grace of God go I (in my younger days).
He should stay in custody until she gets out of the hospital. His punishment should be directly linked to her fate. Then he’ll learn to care about his effects on other people. Especially because of the uncertainty of the length of the sentence. Tell someone they’re going to do 8 months and they’ll settle down to endure the 8 months, and count. Tell them from day to day “Don’t know, can’t tell,” and you’ll make more of an impact.
How about a 2 ton vehicle losing control and veering onto a sidewalk?
“I have no problem with them throwing the kid into prison for life; I just know that there but for the grace of God go I (in my younger days).”
If you intended to hurt or kill people that’s where you belonged.
“Now that is an insane comment.”
I’m not defending the kids; I just hope you don’t have children possibly kill people by causing a car to lose control (with a snowball).
“If you intended to hurt or kill people thats where you belonged.”
I was too stupid to think about the worst-case scenario, but certainly knew it wasn’t a safe thing to do.
