Gov. Mark Dayton on Tuesday ordered an election to allow Minnesota's in-home child care providers to vote on whether to unionize.
But his executive order drew swift response from Republicans who vowed to sue to prevent the vote.
"There is nothing in Minnesota law that provides the governor with the power to do the thing that he says he's going to do," said Sen. David Hann, R-Eden Prairie, who chairs the Senate health and human services committee.
"And I think the real question for us is, what do you do with a governor who won't follow the law?"
Dayton, a Democrat, said he hasn't received a definitive legal opinion but "my belief is that it is within my legal authority."
The American Federation of State, County and Municipal Employees and the Service Employees International Union have been working for about six years to organize the providers.

Many of you have probably heard about the family in Michigan that receives Medicaid for a severely-disabled child. The state declared the parents "care-givers" and since care-givers are required to belong to a union in Michigan, the SEIU (I believe it's the SEIU) skims off part of the Medicaid check as dues before they even receive it.
Limbaugh's right. Unions are nothing but a mechanism by which the Democrats return part of the government's expenditures to their party coffers.
The language of the Executive Order is simply outrageous. The move to secure new union members (i.e. dues $$) for SEIU and AFSCME is couched in its all about the kids and healthy families. Uh-huh. Folks, these providers are not public employees, they are self-employed people (mostly women). They are subject to state licensing requirements, just like many businesses. Parents receive the CCPA subsidy, not the providers.
Governor Dayton has carefully claimed the legal authority to order an election among only those licensed providers who accept the state childcare subsidy rather than all 11,000 providers (CCAP creates a stronger link than just a license between the state and the business, so beware of subsidies if you love freedom) .
