Here's an idea how about before filing a lawsuit at the courthouse you fill out the paperwork to be a CITIZEN!

Here’s an even more radical idea—Now that we know who (and presumably where) they are; how about arresting their illegal a$$e$ (along with those of their families) and DEPORTING them?

Since Wendy was born here and is a U.S. citizen, how's about we give her in-state tuition and deport her illegal alien parents? Sound like a plan?

She is paying $5,000 more than she technically has to...If she isn't a legal resident of the country, she isn't a legal resident of the state, and so "technically" I think she should pay out-of-state tuition.
As a US citizen who pays tons of taxes, and who also had to pay full-boat out of state tuition for my kids, I don't think she should be in line in front of my kids for special tuition breaks. In fact, she should be thankful that she hasn't simply been deported for being here illegally.

So will they deport the illegal parents as soon as they step foot in the courtroom?

because her college insisted upon charging her out-of-state tuition when her parents were unable to produce legal immigration documentsExactly...if you can't legally be here you can't be a resident.

If she wins the lawsuit will this be new defacto immigration policy?

I guess I should file a lawsuit against the University of Delaware for charging me out-of-state tuition. In 1974, DuPont transferred me to Delaware. I was taking courses for an MBA. I purchased a home, I was a registered voter, I had a Delaware drivers license and I could serve on a Delaware jury. BUT the University of Delaware decided I hadn’t lived here a year so i had to pay out-of-state tuition.
The registrar’s words stuck with me: “The state of Delaware has their rule and we have ours.” I shudder to think what their attitude today is.

Why not have the Court just Rule that she has no “Standing”, like U.S. Citizens who question The Messiah’s Eligibility????

I’d like her to explain how her parents are able to live and work here, without the use of fake or stolen documents ?
