Second Hand Dealer Law

Cold hard cash. It's good everywhere you go, right? You can use it to pay for anything.

But that's not the case here in Louisiana now. It's a law that was passed during this year's busy legislative session.

House bill 195 basically says those who buy and sell second hand goods cannot use cash to make those transactions, and it flew so far under the radar most businesses don't even know about it.

"We're gonna lose a lot of business," says Danny Guidry, who owns the Pioneer Trading Post in Lafayette. He deals in buying and selling unique second hand items.

"We don't want this cash transaction to be taken away from us. It's an everyday transaction," Guidry explains.

Guidry says, "I think everyone in this business once they find out about it. They're will definitely be a lot of uproar."

The law states those who buy or sell second hand goods are prohibited from using cash. State representative Rickey Hardy co-authored the bill.

Hardy says, "they give a check or a cashiers money order, or electronic one of those three mechanisms is used."

Hardy says the bill is targeted at criminals who steal anything from copper to televisions, and sell them for a quick buck. Having a paper trail will make it easier for law enforcement.

"It's a mechanism to be used so the police department has something to go on and have a lead," explains Hardy.

I think this contravenes federal law and, besides, why should I be forced to provide a paper trail for the convenience of the police. The dollar, increasingly worthless as it is, is legal tender supposedly good for the payments of all debt, public and private. Bobby Jindal evidently signed this and that drops him several notches in my estimation.

I’d say that this law can be safely ignored unless the Louisiana Dummycrats want to lock horns with the Federal Reserve.

Who are they going to find to enforce it?

It is clearly an illegal “law”, and jury nullification should make short work of it, if the State Supreme Court doesn’t.

Not really sure how it contravenes federal law as the law only delays the payment in legal tender. Oregon passed a similar law regarding nonferrous recycling materials and photo i.d. is required for every transaction. Now, the copper thieves run it across the border...into nearby states.

Unconstitutional in so many ways it would be difficult to enumerate them all.

And so full of loopholes you could drive Obama’s Canadian built campaign bus through them.

For one:
Money orders are free at Walmart.
No ID required to purchase or cash in.
No audit trail.

That is a business decision by the (major) rental companies. This is a state imposed mandate upon ALL 'second hand' sales, INCLUDING Salvation Army, Goodwill, flea markets etc.

How many booth holders at flea markets have Credit/Debit card capability, and are willing to take the transaction fee hit? How many take checks?

How many homeless have the credit cards or checking accounts WITH "acceptable" ID to make purchases in thrift shops, where they had been using cash?

I MIGHT understand and approve of certain business being required NOT to pay cash for items offered to them; but what purpose is served by CUSTOMERS not being able to pay cash for merchandise?

IF if it so compelling, then why are PAWN SHOPS exempt?!?

As to your original question, you're a bit outdated:

Thought you couldn't get a rental car if you didn't have a credit card? That's probably what you've heard for years from rental car agents at airports, but it may be getting easier for some travelers to rent a car without a credit card. A CreditCards.com survey of the top rental car companies indicates that nearly all of the companies allow you to rent their vehicles without credit cards. Cash Only Car Rental Here's another source for cash-OK car rentals, complete with a partial list of U.S. airports that have cash car rental companies available.

Rent-A-Wreck also rents to cash-only customers.

No law can force a customer to use a bank for purchases. No law can require one to have a credit card, a checking account or pay for a money order.
