BREAKING!! Obama's HHS ends controversial program in health reform law (Obamacare dying)

The Obama administration will not implement a controversial piece of the healthcare reform law, Health and Human Services Secretary Kathleen Sebelius said Friday.

Sebelius said the department will not continue trying to implement the CLASS program, which was intended to provide insurance for long-term care. Republicans charged that the program’s financial structure was unsustainable, and Sebelius conceded as much Friday.

“We have not identified a way to make CLASS work at this time,” she wrote on the Huffington Post's website.

Sebelius said HHS will “suspend” implementation of the program.

The department recently reassigned the people it had placed in the CLASS office, following the release of emails showing that HHS officials had raised concerns about the program’s viability even before it became law.

Considering that this bunch has no class in the first place...

Obamacare is nothing more than an attempt for Government control over our lives.

That, and giving away "whitey's" health care that they paid for to "people of color" so they can have it for "free."

I am not joking.

Michelle Malkin: Racial Preferences in Obamacare

Obama Health Care Bill Contains Race Preferences

Obama told a group of blacks and Hispanics recently that ObamaCare was intended to give away health care to those two groups.

There are two "minority" health boards in the new wiring diagram for ObamaCare that will enforce police state racial giveaways for individuals based on race.

It is going to be a nightmare.

Just one of the bribes written in Vampire-care by the Beltway Manchurians and their fascist enablers that call themselves “industry.” They’ll cast these bribes off anytime, to keep their big salaries and pensions.

Their Stepford “media” puppets will gives this so called news little thought.

"I don’t understand what gives the executive branch the authority to pick and choose which parts of it they want to implement".

Hopefully, the Supreme Court will be ObamaCare’s death panel.

"... I don’t care if it is Friday, this announcement will get some attention."

That old notion of 'Release bad news on a Friday' started dying the moment that Internet-based news was born: Drudge could have his "OBAMACARE UNRAVELS" headline up all weekend long. Friday dumps can no longer be ignored.

Yet another reason that the old guard traditional newspaper outfits hate the Internet. They can't control the flow of information like they could in the old days.

So for those who don’t have any daily dealings with the Long Term Health Insurance field, let me bring something up.

The bureaucratic halt to this subprogram of ObamaCare was announced around Memorial Day, however the LTC exchange theoretically could have been sustained if Congress passed a large funding in the FY2012 budget. OBviously that wasn’t going to happen and every knew it wasn’t going to happen in May.

What’s her name from Kansas and the rest of the Obama Admin just let this slide along seeing if their fortunes would change over the summer.

DO NOT GET EXCITED ABOUT THE SUSPENSION OF THIS PROGRAM. The funding of the bureaucrats in charge of writing the regulations for the program are still funded and will write finalized rules no later than 2014, it will still be the law of the land if the Democrats or RINOs retake control of the House.

Hey, GWBush sold us up the river on Medicare Rx Bill, it’s not beyond a reasonable doubt the next RINO will do the same for Medicare LongTerm Care Insurance Exchanges. Gotta buy those Grey Panthers votes one way or the other.

regards,

I agree with everything you said but note that there is still a line item budget paying for the staff to write the regulatory bureaucracy of implementation.

I seem to recall some talk about a “non-sever-ability” clause; that would prevent O’bummer care from being selectively implemented. What happened?

We no longer have a constitutional republic. We have -- in effect -- mob rule, mediated by the mass media. The media appoints a figurehead "ruler," and when he/she proves a dud, they appoint another one.

I still believe, however naively, we as Americans are unique and this lawlessness will eventually be rejected and not by politicians but by average 'educated' Americans. As Rush and Mark like to say, 'Conservatism is in ascendency.' But it's going to get a lot worse before it gets better.. and that's fine by me. This parasitical class of people must be driven to the wilderness once and for all and for all to see. Done.. Dead.. and Despised. Our emphaticness must be similar to those eastern Europeans who threw off the Russian bear. They spit and curse every time mother Russia is mentioned. The average American hasn't got it in their bones yet... but God willing, they will.

The U. S. Constitution requires the Legislative branch to make the laws.

So why was Obama involved in creating the jobs bill or the health care bill or any other bill??? Hasn’t he overstepped his Constitutional authority??? Why is Congress standing idly by while he is violating the Constitution???

I hope that the Huff post and the other crappy liberal bloggers are all banned from the white house or even access to the President and the new admin when we take back power.

This law is breaking apart just as the new law with don’t ask.

Neither were done in the right way, no proper investigation was done into it.

both were rushed and forced through because of a liberal agenda.

My biggest problem with bambi care is exactly this, giving HHS secretory power to make these decisions? Granted really Bambi’s decisions but how do they cut out congress? Is this a new thing or did other administration sign bills into law letting congress default on major decisions?

The abominable law is chock full of “...as the Secretary shall determine.”
The Obamanation lawyers will find some weasely way to justify anything, just compare what DOE is saying about Solyndra loans (it’s trying to say it’s above the law).

With this administration, I wouldn’t be surprised if it did turn out to be across the board anarchy!

I would think this violates the Impoundment Control Act of 1974. Zero should need to request suspending the program, then both the House and Senate must approve it within 45 days.

“Does an agency have that type of authority?”

You can imagine what would happen if a Republican HHS Secretary opted to suspend implementation of all of Obamacare... It would be a lawyers’ field day.

I believe the law is written such that they can make implementation decisions. Our legislators have granted the executive the power to ‘legislate’ that way.
