One the best shots opponents of ObamaCare have at defeating the 2009 law isnt its repeal through the legislative process. Instead, it is said the bill could be ruled unconstitutional by the Supreme Court for its mandate requiring individuals to purchase health insurance. And that would force Obama or the next occupant of the White House to start all over on reforming health care.
However, Washington Post columnist Charles Krauthammer doesnt think that the judicial system acting on the issue and rendering judgment will be a bad thing for the president either way. On Fridays Special Report, Krauthammer said either two of the possible outcomes would be a win-win for Obama.
I think for Obama, its win-win, Krauthammer said. If it is upheld, then it will give something of a boost to public opinion because it will be seen as legitimate. It will help its legitimacy and at least slightly marginally increase its popularity.

Let’s be clear -
If the SCOTUS rules it Constitutional - we don’t have a meaningful Constitution anymore. We no longer have a Federal government of “limited and enumerated powers”. If anything - this MOTIVATES the anti-socialist Americans. The final statement of “see what happens when you don’t pay attention.”
We have a central government of apparently unlimited powers.

Krauthammer’s right. People here just feel obligated to disagree with him for some reason. If the Court rules it unconstitutional, it will become a rallying cry for liberals who must turn out to vote to assure an Obama victory — if for nothing else than to turn the Supreme Court liberal.

He’ll try to blame Congress, but the fact that brand name is seared into everyone’s mind as “ObamaCare” will make that quite difficult.

I understand you and understand Krauthammer. But the only worry for us is if Obamacare is defeated in the SCOTUS.
Up until the national elections in 2010 Obama’s poll numbers were nose diving. After the election, and the replacement of democrat House leadership with the Republicans they started to rise again. Why?
It’s not us, the Conservative Right, nor the Liberal Left that changed, it was the Mushy Middle. They were disturbed by the democrats by the Falll of 2010, enough to vote Republican again. Many voted against Obama and Pelosi by voting for their local House representative Republican candidate. While we didn’t grab the Senate, we came close. Gone is their 60 seat majority.
When it was all over, the Mushy Middle were satisfied that Obama and Pelosi were stopped and went back to American Idol and Dancing with the Stars.
The Mushy Middle doesn’t like Obamacare, but truly they don’t understand how dangerous it is; but day-by-day, word is getting out as deadlines approach, and companies drop health insurance as they forsee rising cost thaey cannot afford, etc. The Mushy Middle i going to get screwed.
If the Supremes defeat Obamacare, then that threat is over. If they sustain Obamacare, then the Republicans have a winning battle cry with which to garner Mushy Middle votes.

It seems like this will put focus on the Supreme Court and remind voters that we dare not let Obama be the one to appoint any more Justices. Also, rulings don’t take topics off of the table, ie look at abortion. Sometimes a ruling highlights and revs up discussion.

SCOTUS ruling it is constitutional...well, it will still be unpopular with a political solution: defund the damnable atrocity. The Republican nominee can show over and over again how the conservatives in government want to apply the LAW-MAKING POWER OF CONGRESS (see: Article I, section 1) to the health of the nation. “We will repeal this unwise legislation.”
SCOTUS ruling it UNconstitutional...well, break out the sound bites and the celebrations Hussein held over this singular piece of legislation—the Republican nominee will be able to show constant reminders of how Hussein put the country through nearly 4 years of unconstitutional law—and how much it COST us in jobs, peace of mind, etc.
Obamacare is the cornerstone of the AnointedIdiot’s foundation; as such, I respectfully disagree with Krauthammer’s assertion(s).

I was listening and that is NOT what Kraut said. He said that obamaprobably considered it a win win.
No, it won't be considered legitimate, the Supreme Court will be viewed as failing to correctly interpret the Constitution.
