Advocates for the unemployed have cheered a push by the Obama administration to ban discrimination against the jobless. But business groups and their allies are calling the effort unnecessary and counterproductive.
The job creation bill that President Obama sent to Congress earlier this month includes a provision that would allow unsuccessful job applicants to sue if they think a company of 15 more employees denied them a job because they were unemployed.
The provision would ban employment ads that explicitly declare the unemployed ineligible, with phrases like "Jobless need not apply." As The Lookout has reported, such ads appear to have proliferated in recent years, prompting an inquiry by the Equal Employment Opportunity Commission.

Does anyone ever recall seeing a disclaimer like this in any advertised job opening?
It's one thing to claim discrimination, another to prove it. But at the very least, it gums up the works with lawyers and lawsuits.

It should be up to an employer to fill any position as they see fit. If they only want to hire people who are currently employed, that should be their perogative.
Once you go down that slippery slope there is no stopping.
I think Obama knows what he’s doing - it just isn’t what most Americans expected.

Well, Obama never had the right. He lost the middle for being an incompetent leftist douche, and is losing the Left for being too “moderate.”
All he has now is to pander to the left, and hope he can have high enough turnout to beat the GOP nominee. Since his own party is now turning their backs on him, he has little shot of doing that, IMHO.
Right, and age is pretty easy to narrow down to a few years’ range by graduation date and employment history timelines...

1) All of us conservatives should quit our jobs and become unemployed.
2) All of us conservatives should THEN apply for jobs at various lefty organizations like the ACLU, the Democrat Party and the NAACP.
3) If they reject our applications we the sue THEM...OR...If they accept,we convert these organizations into conservative instruments.

That’s insane. I’ve done lots of hiring, and a red flag on a resume is if you see a time period of unemployment.
I suspect their goal is to make everything under the sun illegal. Not that they would necessarily prosecute everyone that breaks their infinite set of laws, but it’s always nice to have to option to do so.
It is a genuine, acknowledged behavior of HR departments. They do immediately pass over unemployed applicants for those still employed. It certainly happens in the tech sector.
I don't know how you encourage businesses to look beyond employment gaps in this economy and actually consider applicant's qualifications.
One imagines a defense to the discrimination charge would be, "I didn't hire this unemployed person but I hired a different one." Companies could stop hiring.

Because it is discriminatory does not mean it is illegal if there is a rationale behind the discriminatory policy. If that were the case, woman would be at the front lines and nationally we would have gay marriage.I personally believe a no unemployed need apply policy is unwise but there are some employers that subscribe to the notion that an unemployed person’s skills or motivation have degraded to the point that they are unemployable or not as employable as a employed person.That is quite different from the notion a person’s race makes him less employable which on its face is ridiculous.The class of unemployed and race are not equivalents. The government has no business legislating a new protected class of unemployed people.
Maybe the Gibson Guitar unemployed can sue Obama for discrimination against the company and causing them to lose their jobs. I wish.
