EPA to property owner: 'Your land is our land' $40 million in fines pending over plan to build

Just imagine. You want to build a home, so you buy a $23,000 piece of land in a residential subdivision in your hometown and get started. The government then tells you to stop, threatens you with $40 million in fines and is not kidding.

That's the case now before the U.S. Supreme Court, with briefs being filed today by the Pacific Legal Foundation on behalf of a Priest Lake, Idaho, family, Chantell and Mike Sackett.

Attorney Damien Schiff, who will be arguing before the high court in the case, said it's simply a case of a government run amok, and it poses a potential threat to perhaps not every landowner across the nation, but untold millions.

"Constitutional Chaos: What Happens When the Government Breaks Its Own Laws"

The Sacketts, Schiff said, "bought property, and the government in effect has ordered them to treat the property like a public park."

"The EPA has not paid them a dime for that privilege," he said. "The regime we have operating now allows the EPA to take property without having to pay for it, or giving the owners the right to their day in court.""

I’m not familiar with the Constitional basis (Article,etc.) on which this agency is premised.

Perhaps there is none?

Does the EPA think it has the right to claim some form of eminent domain without paying for the property? Does anybody know if a case like this has gone to the Supreme Court? I just have questions after reading this article.

Uncle Sam is wearing jackboots and goosestepping these days. The U.S. Government is out of control. I never dreamed I’d see this in my days. I thought that America was better than that.

Did anyone notice that the order was in Oct 2008? Who was in charge? Democrats in Congress and GWB as President. This crap has been going on too darn long. Nobody ever goes back and cleans out the garbage in the laws that are put on the books. Where was the Republican cogress in the 2005? Did they kill any regulations and send the bills to GWB? NO. Citizens we have a problem.

This situation could be foreseen the moment there was anything like an EPA. Why the government doesn’t have to compensate for this like any other eminent domain taking, maybe because nobody got it to the USSC before.

If this property belonged to someone the EPA man knew to be a Cartel or Tony Soprano type,,, wonder if they would have pursued this in this manner?
If they knew the person to routinely use violence. If they worried they might likely open their mail to see a photo of their children walking into school,,etc.
Would they have enforced their rule in the same way?

The bureaucrats pick on easy targets.
They are not frightened of us the way they are in some parts of the world. It will be sad for all of us if they force America down that path.

Last,,, ever hear of EPA going after Mexican Cartel marajuana grows in our forests? They divert water, use chemical, crap in the woods, etc. Or the widespread pollution on cartel routes on the border? Wonder why?

I don't think it's possible to fix this by winning a few elections.

What about a Constitutional Convention? There are far more red states than blue. We the people could convene and absolutely gut the federal government back to the level of our founding. The only thing remaining intact of course would be the military. The convention could also address the obvious flaws in our original founding documents. Things like clarifying or better yet eliminating the commerce clause altogether. Clarify the wording of the second amendment so that it's an absolute individual right. Clarify the fictitious “separation of Church and state”. And lastly, establish strict term limits on all public offices that would make careers in national politics impossible.
