Summary of incident
Co-defendants
Ward, Shelton Aaro
On 2/14/2002, in Tarrant County, Texas, Foster and co-defendant Ward sexually assaulted and shot a 28 year old black female, resulting in her death. Foster and Ward then moved the body of the victim to a ditch where it was discovered by workers who were laying pipe.

He is not contesting his guilt, of that there's no doubt.
From what I've read, the stay is based on a claim the double-murder's race (he's black) entered into the punishment phase, potentially tainting the jury's decision to vote for the death penalty.
I think we can agree, if this was a white perp the execution would proceed as scheduled.

So does that mean no execution at all, or more time to review evidence or what? It means more time for appeals. He's not off the hook. He's not arguing guilt, just death.
Looks to me, worst case, a court might order a retrial on the punishment phase to see if a new jury would give him the death penalty too.
