WASHINGTON, August 12, 2011 (LifeSiteNews.com) - In a major blow to the Obama administration, an appeals court on Friday sided with 26 U.S. attorneys general who say the president’s health care law is unconstitutional for forcing U.S. citizens to purchase health insurance.
The decision came from a 3-judge panel of the Atlanta, Ga.-based 11th Circuit Court of Appeals, and was split 2-1 against the mandate.
“This economic mandate represents a wholly novel and potentially unbounded assertion of congressional authority: the ability to compel Americans to purchase an expensive health insurance product they have elected not to buy, and to make them re-purchase that insurance product every month for their entire lives,” stated the opinion as quoted by Reuters.
Politico notes that this is the first ruling against the law by a judge appointed by a Democrat.
Former President Bill Clinton appointed Judge Frank Hull, who on Friday joined the opinion of Chief Judge Joel Dubina, a George H.W. Bush appointee.
The Obama administration may either call on the full appeals court to review the ruling, or appeal directly to the Supreme Court, a decision due within 90 days.
The same law awaits a ruling in the 4th Circuit Court of Appeals in a lawsuit brought by the state of Virginia.

Frank Hull is a first class judge. I knew her back when she sat on Fulton Superior Court. I was lead counsel in a real hot-potato case: a challenge to the City of Atlanta/Fulton County "assault weapons ban".
She is indeed a liberal, and she told me she wasn't very happy about ruling in our favor, but the law was on our side and that was that. I told her I understood. :-D
So she doesn't let her politics interfere with her judging. She's also extremely smart (she was a partner at a big Atlanta litigation firm before she went on the bench).
She is an excellent judge and a real "profile in courage". She's going to catch some flak from her colleagues for this.

Proving that knowledge of the law or the case is only of marginal importance in the decisions of the judges. Much easier to just read the NYT before making up your mind.
This is an encouraging ruling but watch out for the Dems to devise a plan B to circumvent the decision, if the USSC should uphold it. They are not going to give up easily and will happily skirt the law to do it.
Any decent human being muchless a President would say my bad and delete ObamaCare. He knows it is harmful and controlling and does not care.

Obuma isn’t omnipotent; he’s delusional but he will recognize superior firepower. He’ll do exactly what the 2nd Marine Division coming up I-95 tells him to do.

I expect the Obama administration to attempt to drag out this decision anyway that they can. I guess that will mean going for a full court in the appeals decision and then on to the Supreme court, hoping to drag it out until after the election next year.
Just part of the fumigation process that the next occupant will have to do - clean out the vermin!

We must keep hammering away with our outrage that a Marxist-Socialist man occupying the presidency, and his minions, want to tell us what we must purchase, month after month for the rest of our lives. And we know what that means, a complete manipulation of the Commerce Clause to bring us into universal bondage to the federal government, in every area area of our lives.

At least in the interim, Republicans can use this decision against him to reinforce the misgivings and fears that many people have about Obamacare.
I agree. If there are enough Dems sitting in the Atlanta Federal Court appellate district the Obama administration would be foolish to forego asking for a full court review to try to get the decision overturned.They are not about to leave stones unturned.
