The Muslim woman was awarded $20,000 even though she never worked at the store. Pundit Press reported:

Claiming that Abercrombie Kids did not hire her because she wears a hijab, a jury in Tulsa, Arizona has awarded a Muslim woman $20,000 in damages. This comes despite the fact that the woman, Samantha Elauf, didn’t work a single day for Abercrombie and despite Abercrombie’s “Look Policy” that states clearly that it will not hire people who do not conform to their dress code.

During her job interview with Abercrombie, Ms. Elauf wore a hijab, a piece of clothing that Ms. Elauf believes is religiously mandated. At the time, she was informed that Abercrombie would not be able to hire her, not on religious grounds, but because she refused to remove her head scarf.

Abercrombie has, what they call, a “Look Policy.” In other words, because they are a fashion store, they want people to dress in their fashion and their style. Ms. Elauf stated that she would not take off her hijab even if she was hired and was at the job site. She was then informed that Abercrombie had decided not to hire her. So Ms. Elauf sued…

I wouldnt have hired her either.

Actually, I would have simply stated, "We found a candidate better suited for the position" and left it at that. She can go pound sand.

This sets a bad precedent. So next, they’ll have to hire a woman with a nose ring, or a guy who has tattoos all over his face, if the applicant claims it’s part of their “religion”.

they must select juries by using the DNA instead of open questioning.

Not to worry.

My eyebrows start to raise and my eyes go into rolling mode when I see ‘pundit press’.

Now ‘they’ can accuse me of profiling.

All that is needed for the story is dated April 1.

Not that I don’t believe the story isn’t true, it most probably is BUT I can’t believe the award will stand.

I guess that means if I go to a job interview with my ‘dowingy’ in full view, if I am told it is company policy to be covered at all times and ‘dowingy’ must be holstered or sheathed, I can than sue on the grounds of discrimination because I am a charter, card carrying, founding member of the “LET IT ALL HANG OUT” Society...

Is this a great country or what....

This is a real problem in our legal system. The jury in a case like this is usually comprised of the 12 stupidest people not in jail. In a civil case like this I think you only need a majority. Lawyers can correct me if I'm wrong. So the plaintiff lawyers have got very good at jury selection. They can easily determine those people who are predisposed to give away other peoples money.

Not being a lawyer, how do I know this? Because I have a close friend who is an attorney that fights this type of madness. He tells me it's all about getting the right jury and that's pretty much what you need in a civil case. Jurors make decisions, not based on the principles of law, but for mostly political and financial reasons. The system is either broken, or simply doesn't work for the current demographic.

If someone caused $20,001 worth of damage to the muzzie’s property I wouldn’t be terribly saddened.

She deserved nothing and stupid juries regularly make the wrong decisions. Hopefully it gets overturned on appeal and she’s forced to pay Abercrombie’s attorneys’ fees.

Agreed.

Abercrombie was very stupid in stating the reason for not hiring her. Any woman who shows up for a job interview wearing a hijab is going to be trouble regardless of whether you hire her or not.

Looks like A&F did hire her after all! She got the ideal job, paid for nothin’! Me thinks she got a sweet deal. Now, she can go to work for a real fashion place like Macy’s which does hire women who wear those things on their heads.

There is already all sorts of precedent for litigation on all that stuff. Since the facial piercings originated in Africa, having a rule against them is RACIST, doncha know...

Ridiculous verdict on a NON-ISSUE situation.

What this does show however is how adept lawyers grab the minds and reasoning powers of normal American jurors and re-direct them toward the ridiculous... which is what we got as a verdict.

We just saw this play out in the Casey Anthony verdict in Orlando, FL.

I think the term that defines it well is.. "garbage in.. garbage out".

So the story is a fake?

As I understand it, winning an initial failure to hire case (even if backed by EEOC), rather than wrongful termination, is extremely difficult.
