Angelina County jury finds man guilty...after being mistaken for burglar in his own home

A Lufkin man convicted of resisting arrest in his own home after police mistook him for a burglar was sentenced Wednesday to 30 days in jail and a $500 fine.

Marco Sauceda, 30, entered County Court-at-Law No. 2 Judge Derek Flournoy’s courtroom Wednesday morning wearing a tan button down shirt and navy dress slacks, but by the end of the day found himself in county orange.

Following a one-day trial and four-hour deliberation, a six-panel Angelina County jury concluded Sauceda was guilty of resisting arrest on March 15, 2009, while being pepper-sprayed, shot with a pepper ball gun and wrestled to the ground by nine Lufkin Police officers in his own living room, according to testimony.

This looks like the kind of situation where the police could very easily have dropped the charges, and no one would have been the worse for it.

Lately juries scare the livin’ heck out of me. Just when I think a jury can’t be topped in the stupidity department, along comes another jury that tops it.

You don't? You don't have the right to lock yourself in the bathroom and refuse to come out when the police storm your house??

Well, you should.

This was a place for jury nullification.

The judge said he passed sentence while bothered the defendant wouldn't speak - but the defense attorney said the man is mentally retarded. Were there any medical witnesses?

If this guy is so stupid, why the heck isn’t he in some kind of institution? The guy has to have at least a modicum of sense if he can buy or rent a house, hold a job, or put his pants on. Put him in jail for six months and teach him to speak English.

Hmmmm... maybe because he is afraid the cop is like the one in Ohio who threatens to "cave your head in", "bust you in the mouth", and "pull out my Glock .40 and empty 10 rounds into you for being stupid". (Or words to that effect)

Now days when you are approached by a cop, your "fight or flight" instinct might be all that keeps you alive. EVEN if you are an innocent, law abiding citizen.

This was a place for jury nullification.

Most people are unaware of the concept and just do what they are told. The psychology also works against it: If someone is guilty as sin, the jury looks for any tiny doubt to acquit and if someone is innocent, juries look hard for any tiny possibly overlooked reason to convict.

Exactly where jury nullification can come into play. While others squeal about the Casey Anthony jury, they were obviously brighter than the jury in this case.

I’m guessing this jury followed the judge’s direction exactly.

I wonder if obama is going to say “The police acted stupidly.” Probably not.

I watched “The Five” today and they were talking about video taping cops. It was sickening that I had to agree with Beckel. Most of the “conservatives” did the “If you’re not doing anything wrong, why worry? bit.”

What institution?

Where have YOU been for the past 30+ years?

The Institutions were closed down and the inmates out on the street - their 'civil rights' you know.

But this guy, from the story, seems to be able to function enough to take care of himself, even though the mentality of a child. Many people in this state of mental retardation can be trained to be self sufficient. It looks like he was doing a good job. This is the last thing he needs.This is CRIMINAL. The judge, the police and the jury are retarded.

A child would be scared sh*less in this situation and likely done the same thing - run to a room and lock the door.

Duh...
