No charges filed in Phoenix TSA groping case

No charges have been filed against a Colorado woman arrested on suspicion of groping a female Transportation Security Administration agent in Phoenix, the Maricopa County Attorney’s Office says.

After initially reviewing the case against 61-year-old Yukari Miyamae, the County Attorney determined the facts alleged did not rise to the level of a felony offense under state law and referred the matter to the Phoenix City Prosecutor for review and possible charging as a misdemeanor.

I would think the TSA is going to have to be careful about what they consider to be “felony groping”....

Not only is the TSA, as a body, going to have to be worried about what they think is felony groping, they are going to have to start reviewing the mental stability of their agents ~ apparently the TSA agent was into more than her fair share of WISH FULFILLMENT.

Good sign, even they couldn't handle to spotlight of glaring hypocrisy.

But I'm a little confused. Why is it the City prosecutor who has jurisdiction over this, wouldn't this fall under federal jurisdiction?

BLUF:

No attorney general, at either the state or Federal level, wanted to push this case not because of it “rising” to the level for prosecution.

They didn't want to answer:

“Okay, why is it legal for TSA to grope a person but illegal for a person to grope TSA?”

Once, not if, this question is asked in court and has to be answered a lot of other programs at both the state and Federal level will come under similar scrutiny and be found wanting.

Not yet, but we’re working on it. This lady has had to deal with these pr**ks twice a week for months (she commutes from CO to AZ). It is worthy of note the Judge, when he released her, specifically allowed her to continue to fly.

TSA likes to hand its general public arrestees over to local law enforcement authorities so that they can do the legal dirty work, rather than bringing in the FBI.

I would not recommend that. Unless you are a business traveler and go all the time. Most of us are leisure travelers (don’t fly often), and we get no slack.

The TSA know they are hated.

They are just hoping that with a minimum of bad PR, in 5-10 years everyone will just accept them

Local prosecutor - no charges will be filed in my opinion. He has heard of Jury nullification, and it would only take one of 12.

Makes sense, and an interesting concept.

If the City and/or States have jurisdiction over these charges then common sense would dictate they can also make the rules.

This could get interesting.
