The Kenneth Gladney beatdown case continued this morning in St. Louis County Court. After a health care town hall meeting in August 2009 St. Louis native Kenneth Gladney was beaten, kicked and called racist names by Rep. Russ Carnahans SEIU supporters. Gladney spent the night in the hospital after the beating.

Cant the Judge overturn the Jury if there is compelling evidence such as video?Not an acquittal in a criminal case.

Cute. Nope, but I read the linked article about how the defense highlighted Gladney’s post-incident conduct. (I’m not sure I agree with the judge’s decision that the conduct was relevant, however, at least in a criminal case where degree-of-injury isn’t generally an issue. Either they hit the guy without legal justification, or they didn’t, and to any person with eyes, they did.)
