In other words, the international court made clear that Leal is entitled to a certain procedure, namely a hearing. That being so, a domestic courts guesses as to the results of that procedure are, as far as our treaty obligations are concerned, irrelevant.
Breyer, Ginsburg, Kagan, and Sotomayor just spit on one of the most revered decisions in SCOTUS history [Marbury v. Madison].
It is also not entirely unworthy of observation that, in declaring what shall be the supreme law of the land, the Constitution itself is first mentioned, and not the laws of the United States generally, but those only which shall be made in pursuance of the Constitution, have that rank.
The passage from the Constitution that Marbury refers to is:
Article VI, Clause II:
This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.
IOW, treaties CANNOT supercede the Constitution. And, as long as ALL of the Constitutional guarantees afforded the accused are adhered to - then the 10th Amendment applies and it is a State issue ...

Senator Leahy introduces legislation, a few days ago,
recognising the ICJ. the defense appeal, with this ‘law’.
today, the USSC decides in favor of Texas.
repeating, the law is NOT passed, only introduced into the Senate.
Republicans need to make this an issue.
Before we go all ape**** on the ICJ, it only asked that the U.S. comply with the terms of the Vienna Convention. I don’t have a dog in this hunt, but it should be noted as a historical point.
