Emily Good to sue Rochester Police Department (videotape at traffic stop)

The Rochester woman whose run in with the law with her iPhone and made national headlines, plans to file a lawsuit claiming Rochester police violated her civil rights.

Donald Thompson, attorney for Emily Good, told News 10NBC's Ray Levato Tuesday they may sue the individual police officer involved in her arrest, the Rochester Police Department, "any or all of the above and that's something to be discussed and considered."

Good was arrested in her bare feet and pajamas while standing in her own yard one night in May while taping a traffic stop that happened in front of her 19th Ward home. Good kept recording even after an officer asked her to stop and go inside. She was charged with obstructing government administration.

Monday, the District Attorney's office asked City Court Judge Jack Elliott to dismiss the charges because a review of the evidence showed there was no legal basis to prosecute.

Thompson says, "Her stated reason for video taping in the first place was that three white officers were stopping a young black male. And she's obviously attuned to social issues and concerns. There's nothing wrong with monitoring the course of those proceedings to make sure the correct procedures are being followed."

Thompson says says the lawsuit will claim a violation of Good's civil rights under the guarantees of the First Amendment. He said they will either file it in state or federal court.

"There was no crime that she committed here," says Thompson. "There was no basis to arrest her. There was no reason to forcibly take her from her property. It's a violation of her civil rights."

"It was pretty far over the line," says Thompson. "That's why it went national. "

Let me go on the official record and say it as plainly and clearly as I possibly can:

As I rapidly approach my 60th birthday,
I have NEVER EVER needed a cop to do ANYTHING for me...
...other than to use their rather poor clerical skills to fill out the paperwork I needed to file an insurance claim.

Other than that, I hate cops...
I find them to be something a bit less than worthless...

We are “out to get” this good, innocent cop. In fact, we hate all cops. We are cruel, mean and sadistic.

So, if I read this aright, you are of the opinion that the training police receive to secure an area in which a police action is taking place should be thrown out. That a citizen who is within feet of a police action should be completely ignored?

Let's keep the discussion to the facts of this case, not your hypothetical. When you watch the video you will note it BEGINS with the suspect in handcuffs. When you watch the video you will note of the cops IN FEAR at least one remains with his back to camera. You will also note that the bad cop has to walk many feet to get to GOOD. You will note there are other people accompanying Good (camera does not levitate and continue filming on own)

When you drive I’ll bet you have a tough time with your peripheral vision, right? When you watched the video, where were you looking? Straight ahead at the officer’s? Did you at any time look to the videographer’s right? Did you at any time look down? Did you at any time pay close attention to the amount of movement the camera made relative to the location of the curb, vehicles, power pole, or sidewalk? Did you notice the close proximity of the videographer to the passenger side of the suspect’s vehicle? Let’s keep in mind that she wasn’t using a video camera, but an IPOD. What, perchance is the quality of said device with respect to telephoto abilities? Does her phone have any such capability? No rocket scientists in this bunch.

Ah, I see. Hypotheticals from you and/or your friends here are okay. Connecting this case to all other cases of police being videotapped is okay. But, when I use a hypothetical, that is relative to what happened here, then that’s a no-no.

Actually, officers have no business on anyone's private property unless A). they see a major violent felony or burglary in progress and the homeowner is absent, B.) are summoned or invited onto the property by the owner, and/or C.) have a warrant.

Otherwise, the property owner is within their rights to do whatever they wish to on their property as long as they're not threatening imminent violence towards the police.....Whether the fraidy-cop likes it or not.

What kind of authoritarian society do you want here? You obviously have no respect for freedom, liberty, or the Constitution based on what I've read of yours.

I think if this woman had even moved back to her porch and continued taping, she would have not been arrested. But for her to be standing a few feet away, after apparently expressing her anti-cop sentiments, could reasonably give the cop a reasonable fear for his safety and the safety of others.

The point she made to the cop in the video was that, standing there in her pajamas, he could see that all she had was her iPhone camera.

If the cop was truly concerned about his physical safety, then a rational person would think that he would prefer her staying in the yard, visibly unarmed, than going to the house where she would potentially have access to a rifle.

I simply said that in my 3 decades of walking around on this planet,
I have never had any need for a cop, other than their rather poor clerical skills.

Those are the ONLY times they have any business being on anyone's property? Hmmm. I subscribe to you that most if not all state supreme courts and the SCOTUS disagree. You don't watch any true crime tv shows, do you?

You might want to familiarize yourself with these. The Fourth and Fifth Amendments to the Constitution:

IV -Right of search and seizure regulated

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

V - Provisons concerning prosecution

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use without just compensation.
