Alabama's Tough New Immigration Law Can Withstand Legal Challenges, Experts Say

Alabama's new law cracking down on illegal immigrants will likely survive legal challenges from advocacy groups that say it is unconstitutional and racist, analysts told Fox News.

The law, which takes effect Sept. 1, empowers police to arrest people suspected of being an illegal immigrant if they are stopped for another reason and requires businesses and schools to verify whether workers and students are in the country lawfully. It also makes it a crime to knowingly transport or shelter illegal immigrants.

As soon as Republican Gov. Robert Bentley signed the bill into law Thursday, the ACLU and Southern Poverty Law Center were vowing to defeat it in court.

"It is clearly unconstitutional. It's mean-spirited, racist, and we think a court will enjoin it," said Mary Bauer, legal director for the Southern Poverty Law Center.

"By signing this bill into law, Gov. Bentley has codified official discrimination in the state of Alabama," said Cecillia Wang, director of the ACLU Immigrants' Rights Project. "We will take action to keep this law from going into effect to ensure that the civil rights and liberties of all Alabamans are protected."

Legal experts told Fox News that they expect the case to head to the Supreme Court where they believe the state will prevail.

"I think the states have the right to do this," said Jay Sekulow, chief counsel for the American Center for Law and Justice. "I think it will be successful."

Um, that law is aimed at AMERICAN CITIZENS. Really? Americans are the problem, not millions of illegal aliens?

So it’s fine to take a job if you’re here illegally — it’s fine to BE here illegally — relax, no one’s going after you — but if you’re an American doing the actual hiring... well, you’re in big trouble, buddy.

The Federal Immigration Authorities and police of all stripes don’t verify whether people are here legally, but employers have to?

Yeah, this decision will fix the problem. Groundbreaking.

Please check back on FR after the Alabama laws that actually target illegal aliens are thrown out so I can laugh at you some more.

LOL! You’re a real piece of work.

Don’t give me that poor employer line. The majority of employers who use illegals know or suspect it and are doing it for personal gain.

E-Verify is free and easy and it’s a fed program.

You can be as sarcastic as you want to be but if the employer takes a few minutes to check it puts the illegal out of work.

I’ve got no problem with E-verify. At least it’s something.

But I am pointing out the absurdity that the POLICE are forbidden to apprehend and deport illegal aliens, even if they “know or suspect it,” but CITIZENS will be prosecuted if they do not act on what they “know or suspect.” Do you think this is rational?

Furthermore, any laws that actually address the clear and present danger of millions of foreign nationals squatting in this country have been consistently thrown out by Federal judges. We found that out here in California. So did Arizona and Pennsylvania. Now Alabama is in the batter’s circle. I would love to be proved wrong, but I don’t think I will be. I wish them luck.

I’m happy to hear you don’t have a problem with E-verify.

I believe we have to take everything we can get in the fight against illegals.

I understand the frustration with the feds not doing much of anything for a lot of years. Obama and Napolitano are flat out for open borders and amnesty now and though I was a supporter of Bush he did not take a conservative stand against illegals.

Some states are trying to do something and there’s no way I’m going to be pessemistic about those efforts.

The fight for AZ 1070 isn’t over, Brewer just announced she’s going to SCOTUS with it. I have no idea what will happen but I’m sure not going to express doom and gloom.

Same for the new AL law and some pretty in the know experts are predicting it’ll stand, I hope they’re right.

We’re on the same side in this illegals thing, let’s fight it together.

For those leftists orgs to fight this law is the height of racism. Racism against the race of every citizen of the USA.

For any organization to support illegal insurgent criminal invading colonists (and fight for them to stay in this country when they have no right to) should be deemed a treasonous act.

They should be put on trial, get their guilty verdict, and then punished with the appropriate punishment. We know what that is for traitors.

In fact only when you denounce yourself completely are you somewhat acceptable liberal-wise. Make sure you don’t have children and abort those you make...because that’s the true goal. Then make sure you pay everyone back for something that didn’t even remotely happen in your generation...because after all you’re still responsible.

And make sure to cater to mediocrity and relativism. Because their opinion on how to run a government is just as good, even if they came from a failed country.

Here is the problem with E-Verify:

The Governor (Nikki Haley) said she told Napolitano that South Carolina cannot enforce illegal immigration because the federal government will not allow the state to look at E-Verify summaries.

Business loves it...hell, once they had it for free. That’s where I’m for nationalism and regulation. Regulate the amount of people coming in, where they come from and review the character of their culture. Young, educated/hardworking and from countries that actually have character and direction. All others will be mildly invited, so we don’t dent the character of America by inviting more idiots.

The whole idea of free-market/open border democracy is a joke. It’s a relativist dream...along with their business allies.
