The U.S. Department of Justice sent a letter to House and Texas Senate leaders Tuesday -- reportedly in person -- threatening a shut-down of airports if HB 1937 is passed.
The letter claims Rep. David Simpson's (R-Longview) anti-TSA-groping bill is against federal law and the Supremacy Clause of the U.S. Constitution. We include the text of the DOJ's letter, as well as a portion of Simpson's reply, below.

The TSA is moving to the Interstate Highway System also. I have seen their goons at truck inspection stations.
If you actually believe that the BS that goes on at airports keeps you safe you have sh** for brains. Israel doesn't grope people, they profile and it works. We don't need the TSA. We need private companies providing security, real security that is provided by profiling.
Violating my 4th amendment rights(which BTW does not guarantee that an airplane will not fly into your house, what a stupid statement that was)does not keep muslims from high jacking aircraft, profiling will.
Absolutely! Until they start profiling - and that means double searching all ME males between 18-50 years of age - the TSA has NO credibility in my book.

So you are saying, stupidly I might add, that we are only protected by the 4th if we are legally obligated to do something? Are we legally obligated to live in a house? If not then the 4th doesn't apply to us according to your idiotic thinking.
We have the right to travel, therefore we have the right to do so without the feds searching us against our will. The 4th does apply and we need to clamp down hard on the feds. If we had some Republicans with ba**s they would defund the TSA.
So per your reasoning the only way that we can travel is by foot because the gov can control anything else with the TSA and always search us.

And is that mandated by statute? Or was it by invitation?
When the flying public protested the enhanced screening and peekaboo machines as invasive and against the Fourth Amendment, some airports started pursuing the private contractor alternative.
Subsequent to that, TSA revoked the private contractor alternative after last Thanksgiving, now making them the only game in town.
If the federal government uses the threat of shutting down Texas airports, it better be demonstrated that it was because they were unsafe, not because the safety was seen to by other means. Otherwise, it will be seen as being purely political.

We are always protected by the 4A.
But if we want access to someone's private property (like, for example, one of Continental's planes), then they are entitled to say: "I won't let you in my plane until I'm sure you're not carrying contraband."
The 4A does not guarantee any supposed right to use or enter someone else's property.

This statement doesn't really follow my thinking, but represents your own strained interpretation of my statement.
The obvious way to interpret my statement is that no one is obligated to enter my home (my personal property) and if they want to enter it, then I am entitled to set any legal ground rules I want for people wanting to enter my property.

I'm pretty sure Santa Fe, NM high school students are entitled to attend prom without being groped.

(Sen. Dan)Patrick claims Dewhurst reason for anti-TSA-groping bill’s failure

As the anti-TSA-groping bill was debated on the Senate floor today, Sen. Dan Patrick (R-Houston) learned he no longer had the 21 votes necessary to pass the bill.
He thought he had 30.
The reason for the drop in support, Patrick said, was Lt. Gov. David Dewhurst’s intervention — “peeling off the votes,” he called it. However, a spokesman for Dewhurst denied that was the case.
“There’s no one against this bill except for the federal government and our Lieutenant Governor, apparently,” Patrick, the bill’s Senate sponsor, said.
