A Wharton judge has ruled that the marriage between a Wharton fire captain killed in the line of duty and his transgender wife was not legal, an attorney in the case said today.
"It is our understanding, having read a draft order circulated by Judge Clapp, that he has ruled that any marriage between Thomas Araguz and Nikki Araguz is void as a matter of law," Mann said in a prepared statement sent by email a few minutes after 5 p.m., when the judge's office was closed
In his statement, Mann said he anticipated that Nikki Araguz's legal team would file an appeal.
"We anticipate successfully defending the court's ruling throughout the appellate process," the statement said.
Nikki Araguz has said she will appeal the matter to the U.S. Supreme Court and last week announced that she is opening her life to new scrutiny through a proposed television reality show to be called Being Nikki.

If HE is going to challenge this decision all the way to the US Supreme Court, you can bet your bottom dollar that this isn’t about some guy trying to collect $600,000 in benefits from a dead firefighter.
The lawyers in this case wouldn’t come cheap. It’s about pursuing an agenda.
From the video I just saw of this person she looks female.
Maybe she’s one of those people who should have been a woman.
Well, if she wants to go into debt pursuing something that won’t go in her favor, that’s her choice I guess.
Funding for the case is probably not coming out of HIS pockets/purse. The lavender mafia wants to change law in the courts the way they did in the Lawrence v. Texas case.

Regardles of what she looks like, going on Springer for $500 to embarrass her husband is a low blow for anybody to do.
She was living stealth for a while and spent quite a bit on surgery to get it done.
I have to say the surgeon did a marvelous job but what is wrong here cannot be fixed by surgery or hormones.
In fact, the real problem has nothing to do with gender.
It has everything to do with character and the law. She betrayed her husband and they separated before his death.

A. The transgendered man is a mentally ill sex pervert. B. The legal system in some states now forces us normal people to pretend that a mentally ill sex pevert who has had vicious surgical mutilation and must take artificial hormone pills for the rest of its natural life is not realy a man but a woman. C. The fireman married this mutilated mentally ill sex pervert when the pervert still, apparently, had his male parts not cut off yet. But that's not important. The important parts are that the legal system is trying to deny the laws of nature and the media is their handmaiden, calling a mutilated mentally ill man a "she" and it even says it on his CA birth certificate.
What I'm wondering is when this vile attempt to overturn and repeal the Laws of Nature created by God will end. People are going to have to stand up against this insanity.
It’s not a “she”, it’s a “he” who is a mentally ill sex pervert who has been surgically mutilated. A side show freak.
Tanssexuals or whatever the aitch they call themselves sometimes have facial reconsturctive surgery since men usually have heavier brow ridges, thicker jaws, etc. These freakazoids spend countless thousands on all manner of surgery to pretend that they are women. I didn’t see the photo but the facial surgery is not uncommon at all.
If he/she had the transgender surgery before they got married, he/she may have a case. Since the surgery happened after they were married, there is no case. The judge is completely correct in his verdict; this case will get nowhere on appeal. It is illegal for same sexes to be married in Texas.
Other comments on this thread may be correct, this is not about the $600,000.00.

Without an objective standard of truth, from Moses and the ancients onward, anything goes and nothing is sacred.
Check the person's DNA. If it's XX then she should have been (and is) a woman. If it's XY then he should have been (and is) a man.
This is not rocket science. XX = female. XY = male. Every single cell of our bodies proclaims what sex we are.
What if you aren’t XX or XY? XXY does happen.
If I read that story right she went on Springer back in 1995 o 1996. She wasn’t married to that fire fighter till about 2 years ago.

Didn’t need to. I’m simply one of most conservatives that doesn’t believe that a woman CAN be born in a woman’s body. Evidently you aren’t one of us.
Have the 'transgendered' freaks tested. If they are XXY we'll handle it then. (I'd guess that we wouldn't find one)
