A Washington, DC-based public-interest group that investigates and prosecutes government corruption reported on Friday that its officials have obtained documents suggesting US Supreme Court Associate Justice Elena Kagan helped coordinate the Obama administration’s legal defense of the Affordable Care Act (also known as Obamacare) while she served as Solicitor General.
During her confirmation, Kagan claimed she was not involved in the Department of Justice (DOJ) preparations for legal challenges to Obamacare. Moreover, the Supreme Court justice did not recuse herself from the High Court decision in April 2011 when she and other Justices refused to “fast-track” the Supreme Court review of Virginia’s lawsuit challenging Obamacare.
The following are highlights from the documents obtained by Judicial Watch as a result of a Freedom of Information Act (FOIA) lawsuit filed on February 24, 2011. (Judicial Watch’s lawsuit has been consolidated with a similar FOIA lawsuit that had been first filed against the DOJ by Brent Bozell and the Media Research Center. The lawsuits are now both before the U.S. District Court for the District of Columbia...)
According to a memo from former Deputy Solicitor General (and current Acting Solicitor General) to Brian Hauck, Senior Counsel to Associate Attorney General Thomas Perrelli, Kagan was involved in the strategy to defend Obamacare from the very beginning...

We can say that about all DemocRAT nominees
I could have figured out the former if I had a clue what you meant by the latter. Sheesh. Nice informative response.
Good strategy — waste your time and mine by making arcane comments on a forum and leave it to others to figure out what you mean. Great communication skills!
Impeach and remove them all then.
One of the things we must do if we are to restore and preserve this republic is to make impeachment and removal the norm for every officer of government who refuses to follow the supreme law of the land, our Constitution.
The lazy Republicans didn’t bother to fight her appointment. Why would they care that she lied? Answer: they don’t. We’ll not hear anymore about this in another day or so. We are stuck with this ultra liberal for the rest of her life.
Seems to me that Most members of congress could be recalled for malfeasance in office or at lease official misconduct. There is no representative government without representation of the interests of the electorate. Our government has failed. we are just afraid to admit it.
What will or can be done?
One instance (Eric Holder) - perhaps an oversight
Two instances (Eric Holder and Tim Geithner) - perhaps a coincidence
Three instances (Eric Holder, Tim Geithner & Elena Kagan)- definitely maybe a pattern...
No surprise! Too late now!
Tell me about it. I forwarded a Doc to Graham re: Kagans conflict of interest and watched as he shrugged it off.
Will Lindseed excuse her lies to Congress as meaningless.
somehow a lying SC-Judge is not good for the reputation of the Supremes.
Can the rest of the Scotus FORCE her to recuse?
With this bunch of Republicans in power? Nothing.
But she should be impeached and removed.
We’ve got another 609 days left of the maobama nightmare.
“Seems to me she could be impeached for lying”
Impeached by whom? The gutless stupid party? The only republicans with balls are a few of the women, the rest are eunuchs.
“Piarte”,”My old fingers meant PIRATE”
I thought you meant Pilate, as in Pontius Pilate.
Elect only people who will impeach and remove every officer of government who won’t strictly adhere to the Constitution.
IMPEACH!!! (And I don’t say that with every posting...)
Who’s that fat guy in the dress?
Oh sorry, it’s Kagan.
Factually correct. This information should be retained and after 2012, when we get the Senate, impeachment should be started. If we do not reverse all of what this corrupt Administration has done America will never recover. This is serious business. We must dump all the RINOs we can in 2012 also.
I don’t either. But I certainly agree.
