The Pima County Regional SWAT team fired 71 shots in seven seconds at a Tucson man they say pointed a gun at officers serving a search warrant at his home. Jose Guerena, 26, a former Marine who served in Iraq twice, was holding an AR-15 rifle when he was killed, but he never fired a shot, the Sheriff's Department said Monday after initially saying he had fired on officers during last week's raid.

Jeez, that was a long time ago and it was a small part of my duties. Interesting work, though. Nike and the movie companies used to send out investigators of their own with us to ID fake products. Most of them are retired feds. Amazing to watch a guy smell a sneaker and tell if it’s fake. The reason? Different glue used than in the real ones. Hilarious.
It's an industry. No way is the government going to dismantle a prohibition that employs thousands in law enforcement and incarceration. Get rid of the WOD, and a substantial bulk of entire federal, state, and local LEO employment would become excess.
There are going to be innocent casualties no matter which way the policy is set.

All of those posts assumed this was a bad guy and I said that repeatedly. If this guy was innocent, I'll be the first one to say bring the cops up on charges. The first one.

Just seeing how far he’s willing to take the sentiment. Nothing more.
I don’t think these two cases are related. But I could be wrong.
I think the general point of many posters is that they are getting tired of the police acting like the military/rambo, more than often against the wrong house, people believing they are being broken into and attempting to defend themselves, getting all their pets killed, etc.
It is odd that they were both shot 7 times and many shots fired. Is this SOP for the local police?
Not picking on you, as I agree with the gist and sense of your post. I post to make the point that the adjective "inalienable" is nothing more than a matter-of-fact observation.
To "alienate" is the act of taking something you possess, and give or sell it to another. We can alienate homes, cars, books, gizmos, and so forth. But some attributes of life cannot be taken from one person, and given to another. These attributes are inalienable.
It is impossible to take your life, and animate a dead person. Your life is inalienable. It's yours, and only yours.
The law will not admit you, an innocent, stand in the stead of an imprisoned convict. Your liberty is inalienable.
Similar with pursuit of happiness, which is inherently a personal state of mind.
I want to know why law enforcement officers do not just do that more often these days? Are they trained to default to using a SWAT team for everything? It seems to me that arresting somebody on the way to or from work would be a lot easier, less disruptive to the community and less dangerous for all involved then kicking in a door at 3:00 AM. Do police really just want an excuse to dress up in their tacticool gear and maybe, if they are lucky, get to shoot a family dog as a bonus?
It is a sad trend here on FR to equate cops and military. They are not the same...as a group or to the individual.
In the scenario you cite I’m pretty sure if they even heard rumors of “that guy’s into booby traps” they would cite some union or department safety policy to nix the raid.
This is a shoot-the-dog incident soley intended to terrorize the citizenry via a public demonstration of their implicit right to kill.
This will only stop when a DA lets it be know anyone doing this will face manslaughter charges. Either that or possibly a Fed civil rights lawsuit.
Why? If they know him to be a criminal then arrest him in the course of committing a crime. Police should not be entering homes seeking evidence of criminal behavior.
