You are correct in this case. Keyes' attorneys did not set the stage properly. Keyes would have to prove he won the election, not Obama, in 2008 to have standing based on Quo Warranto.

What Keyes should have done was sue for civil damages. Punitive damages, albeit quite rare in a civil suit, may also have been awarded. Assuming Obama was out of the running and Keyes finished well enough to receive campaign contributions from the state of California, then he and his team would have standing. Keyes would have had to prove he would have garnered enough votes to obtain those funds in the absence of votes to the Democrats.

First, standing and justiciability are not technical issues. There are wholly fundamental principles of American jurisprudence.

Second, there have been DOZENS of decisions in these cases where the trial court, even after dismissing for standing and justiciability, has gone on to describe these claims as COMPLETELY WITHOUT MERIT and FRIVOLOUS. In fact, the birther queen was fined for her representation in one of these cases.

Not to put too fine a point on this. But it is in fact “computer generated” from a “photocopy”. It was xeroxed at the HDOH, then scanned -assumedly at the WH, further enhanced, then converted to PDF.

I don’t believe it’s killing anyone, especially not those attempting to enforce the US Constitution’s requirements for eligibility, in fact I think it’s essential to ensure that only those properly qualified to hold the office of President are allowed to. Others here seem to agree.

While I have no illusions that Obama will be removed from office this term, if he can prevented from running for re-election based on the FACT he does not meet the definition of NBC as clearly intended by the creators of the Constitution, it is very worthwhile. The curvature on the left was caused by a bound volume of BC’s being placed on a copier fed with security paper (then doctored?). This curature would not typically be on microfiche image which is usually done on unbound flat originals, IIRC.
