He was adopted by a Kansas couple.
I believe that makes him an official citizen.

at the time of the first action comic with superman, immigration law was much different.

you are correct. The adoption establishes he is a citizen ....AND

at the time of his oragin it is not unusual for a child’s birth to not be recorded. If memory serves, in one version the kent’s just stayed inside during winter and in the spring there was the baby.

Not automatically. They would still have to apply for naturalization. But, in 1938, who’s to say the couple didn’t find an abandoned AMERICAN waif?....................
