Their preferred strategy for getting the ruling overturned on appeal was to focus on the law, not a judge's personal life, they said.
Eight months later, Proposition 8's proponents and their attorneys have taken a new position. They filed a motion Monday seeking to vacate Chief U.S. District Judge Vaughn Walker's historic ruling, a move they said was prompted by the now-retired jurist's recent disclosure that he is in a long-term relationship with another man.

i had the same thought. It would be a hard position to argue from a perspective of law.
However, if it is discovered that the judge was some kind of activist for homosexual causes that would be entirely different. If discovery can be made in this instance (I kinda doubt it), it might uncover such a thing. The same would be the case for a straight judge.
difference is that homosexuals are all about how they get off sexually and so when we have a judge who is a homosexual and could benefit from his own ruling then he should have not taken the case or be honest from the get go.
Also a normal male who is a judge does not lose or gain in his marriage by ruling on this where as this homosexuals does
Really? This is a decision that validates and legitimizes sodomistic relationships. Is it unreasonable to assume that a sodomite may benefit from that or support that decision simply as a result of his enthusiasm for sodomy?

The simple truth is that homosexual behavior is a sick perversion, attraction to the same sex is mental illness, and the homo-agenda means the destruction of the natural family, and the freedoms of speech, religion and association. It's that simple. Mentally ill perverts should not be allowed to become judges. If anyone thinks that's harsh, too bad.

The judge who wrote the decision authorizing homosexual marriage, which was at the Ontario Court of Appeal level (our government chose not to appeal to the Supreme Court of Canada), was equally biased. His daughter was a lesbian. He flaunted his bias by attending a celebration party hosted by the victorious freaks, where he basked in their praise. Corruption runs deep in western society.

What I mean is that I don’t see how a willful behavior becomes a mental illness. Anyone can choose to not have sex.
Oh, I agree completely. Someone may have an unnatural attraction towards the same sex, which is mental illness, but choose not to act on it because they know it’s wrong, are trying to change, just don’t want to get diseases, or whatever.
And also by “mentally ill” I do NOT mean “therefore has no personal responsibility for what they do”.
Kind of like my POV about the insanity defense. So insane person murders someone. He may be insane, he should still face execution.
