Finally a Notre Dame legal scholar opines on the birther controversy. Perhaps the Ivy League could now chime in on the REPUBLICAN Congress's constitutional mandate to investigate Obama's eligibility!

This guy nailed it IMO. I’m been screaming this for 3 years.....all it takes is ONE congressperson with balls to ask for the documents. Just ONE and no one will do it.

Precisely why I consider the entire Congress (GOP included) to be accessories to treason.

Heard a discussion of the issue on a radio program a few days ago. The speaker speculated that Obama’s mentor was Penny Pritzker, who felt a person with his abilities needed to be in the powerful position he now holds. That “something” was discovered at some point in the process of moving him up the ladder and a decision was made to cover it up.

If it turns out that Obama knew he was ineligible when he campaigned and when he took the oath as President, it could be the biggest political fraud in the history of the world.

Regardless of where he was born, simply the fact that he took the oath of office is in itself the biggest political fraud. A person whose political philosophy is so different, so completely opposite the values expressed by the founders and the Constitution could not take the oath without knowingly lying.

Before the anti-blog pimping, self-appointed overlords jump in, read the article. It is completely reasonable, devoid of fanatic conspiratorialism, and clearly shows the appropriate way for this to be resolved. Whether Congress will actually do its job is another matter altogether.

The American people do not know whether the current President achieved election by misrepresenting, innocently or by fraud, his eligibility for that office. I neither know nor suggest the answer to that question. But it would be a public service for the House of Representatives to employ its authority to determine those facts and to recommend any indicated changes in the law or the Constitution.

This is the obvious reasonable position all politicians should take. To say yes he is or no he isn't without having the facts to determine one way or another is stupid. The pat answer should be...I don't know because the president has refused to release the documents that would show one way or another and I think he should do so now to resolve the question for the American people.

Was surprised when I first read this article. Rice’s arguments against Roe and abortion in general brought him into prominence well over twenty years ago (and yes, he was at ND then). He’s one of the original Conservatives, great guy, nine (?) kids.

There is no "if" because he did indeed know when he signed his name to SR 511. That committee, along with Chertoff, discussed the TWO US CITIZEN PARENTS issue. So, yes, indeed, he most certainly did know.

Wow! Excellent article. Absolutely outstanding. This is the voice of reason needed for so long on the eligibility issue. Not a hint of conspiracy. No side taken. No conclusions made. Just a suggestion that we don’t know what we don’t know. Therefore, as our directly elected representatives, Congress should investigate our questions and resolve the issue.

At least the report is sober and scholarly, in the traditional sense (which used to be more common in academia than it is found to be today).

Too bad the media does not also conduct their work in such a sober fashion, instead of chasing ratings among those most likely to watch them - the lowest rungs of society, the “masses”.

Take a look at line 4- is that "Islam"??

The word next to it, 'agama', as near as I can google has something to do with spirituality (religion?) and the next line (5) 'murkl' seems to mean 'student' -and there it is again on line 5 "Islam"

The power to investigate can be exercised by a House committee provided that the investigation is within that committee's authorization as determined by the House.

We have the majority in the HOUSE now. I just wrote to my NEW Republican Representatve to ask him to start justs such a committee!

From Woodrow Wilsons book Congressional Government and the article written by Dr. Rice: “The only really self-governing people is that people which discusses and interrogates its administration”. {SNIP}”The House of Representatives is an appropriate body to inquire into the facts and legal implications of a President’s disputed eligibility for the office.”

So what are they waiting for? We have been continuously mis-represented and it’s time for that to stop.

Obama will never willingly provide access to the birth certificate. We know that. Don’t you think that if he’s ever forced to legally provide the proper document, that he’s got that issue covered? Then what? Sure it will be 99% fraud, but what if it’s unprovable fraud? My bet is that he’s covered and if the subject is forced.... he wins.

Nice.

The good things is, there isn’t a person out there who wouldn’t accept the truth if the truth were told. Of course that’s if we’re talking about the people who have questions and it were shown he was born in Hawaii, and didn’t have college documents and others that showed him to be problematic.

This isn’t a ‘go get the Black guy’ moment here. It’s an ‘the American public deserves to know’ moment.

Was Obama born here?
Did he relinquish that citizenship to attend school in S/E Asia?
Did he declare himself to be a foreign national at college?
Did he travel under a foreign passport as an adult?

At the very least, this man swore an oath to protect and defend the U. S. Constitution. Is he living by that oath? Is he qualified to abide by that oath?

Is Obama intent on strengthening the United States, or taking it down?

I’d sure like to to have that confirmed.

First there were the McGovern maniacs. Then there were the Clinton goons. Do we have a foreign national at the helm?

Is this the ultimate terrorism? Yes or no?

I know what my instincts tell me.

On the original document, where are the commas placed? Are the commas placed exactly as in the above excerpt?

Larry, reading the above statement, whom would you say is eligible to be a POTUS?
Now, read it this way:

"No person except a natural born Citizen, or a Citizen of the United States at the time of the adoption of this Constitution, shall be eligible to the Office of President."

Aside: I firmly believe that if Jefferson were not in France and he had more direct input into the Constitution's wording the document would not appear as ‘ambiguous’, for lack of a better term. There would today be less ‘what did the Founders mean? What was their intent?’ if the Sage of Monticello composed it.
