An Oak Park couple is suing the Applebees restaurant chain after their toddler was inadvertently served a margarita instead of apple juice.
Taylor Dill-Reese and Dominic Wilson filed a lawsuit in Oakland County Circuit Court seeking in excess of $25,000 in damages after their 15-month-old son, Dominic Wilson Jr., consumed alcohol on Friday at the Applebees Neighborhood Grill and Bar on 14 Mile in Madison Heights.
Were asking for some accountability, said Southfield attorney William Stern, representing the parents and the boy. This could have turned out very badly.
The boys parents had ordered him a kids meal a small hamburger, fries and apple juice in a sippy cup, then noticed him acting peculiarly. The father tasted the drink and realized it contained alcohol. A police investigation found the apple juice was actually margarita mix containing alcohol. Police say the bottles were mislabeled.
The child was taken to William Beaumont Hospital, where lab tests showed traces of alcohol in his system. The child has since recovered and is at home with his parents.
The incident made national headlines. Applebee's has apologized, and pledged to put into place safeguards to prevent future accidents. A spokesperson did not immediately return phone calls this afternoon.
The suit filed Tuesday seeks compensation for emotional distress and well as reimbursement for medical expenses. The case has been assigned to Oakland County Circuit Court Judge Nanci Grant.
Can you imagine just admitting to something like that today?! lol
We're so “gay!”
When I was a kid my holy roller Pentecostal Grandmother and Grandfather kept a bottle of whiskey in the house for medicinal purposes only. Didn’t matter your age, if you were sick you got a dose of Grandma’s honey, lemon, and whiskey. Even some of the cold meds have alcohol in them. The amount of alcohol in that sippy cup would not have hurt that baby. Hospital visit....BS.
I’ve been known to use adult beverages on my kids’ gums for teething issues. My now 8 y.o. was a happy camper back in the day! LOL Beats having to run to the drugstore for Orajel in the middle of the night ;)
My 3 y.o., who is heavier than and almost as tall as his nearly 6 y.o. cousin, has allergies. Benadryl does double duty for us at night....good night’s sleep and relief from the sniffles and itchy eyes!
Triple their specials, close the file.
“5 bucks says it was a set up by the alleged parents.”
It would VERY INTERESTING to investigate the parents. I would not be surprised at all if one or both had, how do you say, was known by men of the law.
Hey, the high and mighty Freepers can baissez my cul! Incidentally, my kids are all grown, they all like to drink, and they all drink responsibly.
And asking for more apple juice.
Shhhhhhhh,
Don’t let the open minded folk that want to teach your kids that it’s OK to be gay, who want to decriminalize pot etc know that! They’ll turn you in for child endangerment.
it’s just the alcohol that has to be in the original bottle. juices and mixers can be put in whatever you want.
I heard an interview of the mother today.
She is 18 and her baby daddy is under 21.
When they noticed that the kid had the booze, she went into a fit at the bar. The bartender the figured out that someone on shift yesterday put margarita mix in an old apple juice bottle. The profusely apologized and offered to comp the meal.
That’s when the young parents CALLED THE COPS AND EMS.
The parents then took the kid to the hospital and claim that the child had a blood alcohol of .10.
*************but this is where the fun begins*************
While the mom was speaking the radio host was given the police report that stated that the kid was fine and that he had a trace amount of alcohol, approximately as much as if he rinsed his mouth with mouthwash. The released the child at the scene. Mom went ballistic and said that the truth will come out in court.
Remember, it took one business day for this teen mom to file her case. She also said that an apology was no good, something could have happened to her kid.
Margarita mix(up) here.
Every lawsuit is worded that way or similar. It has no bearing on what will be sought once it gets in court.
