An Oak Park couple is suing the Applebees restaurant chain after their toddler was inadvertently served a margarita instead of apple juice.
Taylor Dill-Reese and Dominic Wilson filed a lawsuit in Oakland County Circuit Court seeking in excess of $25,000 in damages after their 15-month-old son, Dominic Wilson Jr., consumed alcohol on Friday at the Applebees Neighborhood Grill and Bar on 14 Mile in Madison Heights.
Were asking for some accountability, said Southfield attorney William Stern, representing the parents and the boy. This could have turned out very badly.
The boys parents had ordered him a kids meal a small hamburger, fries and apple juice in a sippy cup, then noticed him acting peculiarly. The father tasted the drink and realized it contained alcohol. A police investigation found the apple juice was actually margarita mix containing alcohol. Police say the bottles were mislabeled.
The child was taken to William Beaumont Hospital, where lab tests showed traces of alcohol in his system. The child has since recovered and is at home with his parents.
The incident made national headlines. Applebee's has apologized, and pledged to put into place safeguards to prevent future accidents. A spokesperson did not immediately return phone calls this afternoon.
The suit filed Tuesday seeks compensation for emotional distress and well as reimbursement for medical expenses. The case has been assigned to Oakland County Circuit Court Judge Nanci Grant.

100% Agree!!! It’s why I never hide from jury duty. This country needs to be taken back in every way and at every level.
It says that the mix was served in a sippy cup. The cup was likely not clear and couldn’t be seen through. A sippy cup also has a top on it (by definition), and so it couldn’t be seen into. Mind you, it’s worthwhile to consider the wisdom of permitting someone to serve your child beverage in a closed container you haven’t looked into. But I don’t think this is a setup, it sounds like someone did something either stupid or malicious at Applebees.
“I had this happen to my four-year-old daughter on one occasion at a restaurant. A round of drinks was ordered, with a coke for her—she ended up with rum-and-coke, or something similar. I noticed her making a face when she took a drink, and immediately became suspicious.
I brought the drink back to the bar, offered some critique, got an unspiked Coke for my daughter, and then got on with life.”
Better watch out what you post, you may get flamed by the high and mighty Freepers. You know for having your child in place where alcohol is served, even if it is only restaraunt. :)
15 Month Old Hospitalized After Applebees Swaps His Apple Juice For Margarita
When Taylor Dill-Reese took her little one to Applebees, she never expected shed be heading to the hospital after their meal.
According to reports, employees at Applebees in Madison Heights, made quite the mix up when they put margarita mix into Dill-Reeses son, Dominiques sippy cup instead of the apple juice she had ordered for him.
Dill-Reese says she first noticed something was up when little Dominique started acting strangely:
He was saying hi and bye to the walls and then eventually lay his head on the table . He dozed off a little bit and woke up and got real happy.
I agree that this shouldn’t be considered a winning lottery ticket, but I think you were due more than an apology from the bartender. Free appetizers or dessert, at least.

My younger kid ordered a virgin daiquiri on a cruise ship when she was about 9 or 10 and the inadvertently brought a regular one and she tasted some alcohol. Big whoop. We told the waiter and he replaced it with the correct drink and all was fine. That’s how it’s supposed to work. And yes, the waiter did apologize.
This family needs karma to kick them in the stomach and bring them back to reality. Want money??? Earn it!!!
At my parents house, one of the kids came running up to the table and grabbed a glass with clear liquid, took a gulp and then asked for “regular water”..turned out he grabbed a vodka and water cocktail.
The booze was for an employee, the sippy cup was to keep it hidden, the kid getting it was a slip up.
A clue is "her son, Dominique." People who give their son a girl's name are questionable ipso facto.
I’ve eaten at Applebees fairly often, and I’ve noticed that my food always comes from the kitchen, whereas if I order any alcohol the waitress has to make a separate run to the bar.
So....somebody tending bar there put booze in a Sippy Cup?

Alcohol consumed by this todler to register .10 does not equate to the same amount of alcohol that an adult would consume to register .10.......
What kind of moron would put an alcoholic drink in a sippy cup at a family restaurant?
After the attorney's 30% cut then taxes, they'll have enough to buy a decent HDTV and put a down payment on a new car..........There ain't no plans for the kid except maybe some new toys.
