Pulease Get it Right - Tests for Natural Born Citizen

To all the Freepers who keep saying it isn't about the birth certificate, it's about the parent's (i.e. Obama's father's) citizenship:

It is about BOTH. You must be born in country of two U.S. citizen parents. BOTH tests apply. There is some justification for out of country births by U.S. diplomats and Military serving oversees. Obama’s father and mother were not U.S. diplomats or Military serving overseas.

So, If Obama was not born in the U.S. he is ineligible. The long form birth certificate is the most determinative documentation of place of birth. It isn't the ONLY documentation but it is the one that almost EVERYBODY born at any recent time has.

In addition, if one of his parents was not a U.S. citizen at the time of his birth, he is ineligible.

Obama is disqualified by failure of either or both tests.

The Courts WILL NOT ALLOW the 2nd test to be applied. Congress REFUSED to apply the 2nd test. The majority of Americans REFUSED to apply the 2nd test in voting for Obama.

Given that the 2nd test, however worthy, is NOT going to be applied to Obama, what do you propose to do? Throw out the first test as well?

Agree. The folks who keep saying that the question is whether Obama is a U.S. citizen make us look like idiots. If his mother was a citizen and he was born in the U.S., Obama IS a U.S. citizen. The Constitutional question is whether he is a “natural born” citizen, i.e., born of two U.S. citizens on U.S. soil. By his own admission, Obama is NOT a natural born citizen.

The real problem is there is no Constitutional or offical definition of Natural Born.
There is plenty of non official evidence but nothing that would stand up in court

and obamites have already spun it to mean someone born in USA, which of coursre would also include anchor babies.
As opposed to “ citizens” which can serve in Congress and can be naturalized citizens.

I agree. Both issues need to be brought up in tandem. Whenever I hear someone focus on the birthplace, I make a point of bringing up the corollary issue of the parentage. That doesn't mean I think the birth place doesn't matter; it does.

The issue is complex enough that it needs a court decision. The Left wants to wave around a silly COLB and declare that all questions have been answered. No. They haven't. There are multiple issues here, it's not a simple matter, and we need courts to look at the evidence for the place of birth, the evidence of the parentage, and the legal definition of Natural Born Citizen. Then, when all factors are known, they can rule on eligibility.

The media wants to see this as boring and simplistic. That's just not the case.

Excellent post. This is why I keep Trump keeps riding this issue, though I continue to wish he would avoid the foolish comments that make it look legitimate to ignore his rants (e.g., he’s never seen a birth announcement in a newspaper, there’s no pictures of Obama as a baby, such financially strapped parents would not have placed a birth announcement in the newspaper etc.).

Very few, if any other county other than the US makes you a citizen of that country simply because you were born in that country.

Unless you are born in a country that grants you citizenship simply by being born in that country, it’s a moot point.

Thanks for posting this. There also is something about his mother (if it was SAD) not residing in the country for a specific time period prior to birth and being not of majority.

I disagree. It doesn’t matter where Obama was born because he doesn’t qualify by virtue of not having two citizen parents, period. If he produces a long-form BC that says he was born in Hawaii, he still isn’t qualified. That’s why many of us don’t don’t care about the BC - it cannot make him an NBC.

only applies to 0dumbo’s commie mother IF he was not born in USA.
That rule states that a if a child is born in another country a parent must have lived in the USA 5 years prior to birth AND be 19.
She was not m19
BUT unless it can be proven he was NOT born in USA this means nothing

Yes, there is a legal standard, you’ll need to open a few books, namely “Laws of Nations” by Vattell, and a Blackstones Commentary, both of which discuss at great length the “jus sanguine” principle of parentage. The 14th amendment nothwitstanding, a person born anywhere is assumed to have his fathers nationality- to insure each nations’ sons are retained by virtue of birth, not location, and any change in citizenship must be accomplished through courts-denouning of one and acceptance of another-a personal decision, not a simple fate of birth. Assuming US citzenship by virtue of being born on US soil is a departure from the internatioanl norm (dual at best, fathers nation even better).

Under SCOTUS precendent,yes, the 14th amendment grants anchor baby status, but that is a well known and documented perversion of the purpose of the 14th- whic was and should be held to granting US citzenship to former slaves post Civil War. Read up on it some. Amazing what the truth will show you-

Unfortunatley, the situation is not good for the US, the old adage of “be careful of what you ask for, you just may get it”, rings true, eh?

Let's cut to the chase. If he doesn't have or can't produce a legitimate birth certificate, he does NOT exist. If he does not exist, he isn't the President. So then who is this fake?

Maybe you can point me to the one that would be useful in this quest for truth about Obama. I’d love to have that information for future reference and arguements

Where, exactly, can I find the official definition of Natural Born Citizen or Citizen of the United States.

I’m not trying to argue the point, I would just like it for my own reference.
