MADISON, Wis. -- A Wisconsin judge has ruled that there should be no further implementation of a law taking away nearly all collective bargaining rights for public workers.
Dane County Circuit Judge Maryann Sumi said Tuesday that her earlier restraining order saying the law shouldn't be enacted had either been ignored or misinterpreted.
Sumi stopped short of saying the law was not already in effect. She said she will take more testimony on that issue.
The Legislative Reference Bureau posted the law on a legislative website Friday, leading Gov. Scott Walker's administration to declare the law was in effect.
Sumi revised her original March temporary restraining order blocking the secretary of state from publishing the law, which is typically the last step before it becomes effective.

We do not want to lose the Possner seat, but my understanding is that he does not vacate his office until October, so there is quite a lag time.
Well according to Wi statue the law has not been legally published yet. It does not become legal until published in the paper of record, the WSJ I believe. The quickest and cleanest resolution to this mess may be to just pass the law again, meeting any and all notice requirements to the letter. That would take away much of the legal complaint about this legislation.
If judges persist in issuing orders that have no basis either in precedent or in the written constitutions they have sworn to defend, such judges need to be defied and they need to be impeached. Not obeyed.
It has already been published in the WJS by a different organization than the Sec. of State.
Prossers current term ends July 31, 2011. Losing the upcoming election will definitely change the makeup of the WI SC.
Prosser is facing an extremely nasty negative campaign right now involving a claim that he denied a request to prosecute a priest involved in molestation and helping to cover it up. It’s all over the TV right now. The liberals are coming with both barrels blazing.
I am not a lawyer and not in Wisconsin but Walker has been ahead of the liberals at every step - he has been shrewd enough not to broadcast his plans.
No they posted a link to the legislation on their website, not the same as being published in the paper. My info is from the weekend so I will have to research some.
I’m a little surprised by this ruling...I thought the left-wing judge would issue an injunction against the law. I suspect that is what she intends to do on Friday. After that...its off to the appelate/supreme court. It looks like the Wisconsin ‘Food Fight’ has just begun.

That doesn’t surprise me at all.
People like her have no sense of propriety at all. Their agenda trumps all.
I agree that he has managed to stay ahead of his opposition so far. The problem is it seems like he has had to ‘bend’ the rules some to do it and that has led to todays legal issues.
When majority fails to rule-we have problems. I suggest Wisconsin immediately re write it’s rules (similar to an association’s by laws) to cover Internet meetings and voting, similar to go to meeting, many organizations use rewriting their by laws to cut down on expenses.
We could cut out a lot of fat/pork by having our Congress meet and vote on the Internet. Robert’s Rules would work just fine.
The critical imperative is to win the judicial election on April 5. It is critical. If we can hold that seat, the union forces in Wisconsin will depart for other pastures.
