Georgia scientist pleads guilty to punching girl on ski slopes (41yr old man punches 14yr girl)

A Decatur man accused of punching a 14-year-old girl in the face for running into his son on the slopes in Colorado has pleaded guilty to third-degree assault.

The Vail Daily reported Tuesday that the plea from 41-year-old Scott Filler, a renowned malaria expert, was for a misdemeanor stemming from the December incident at Beaver Creek Ski Resort.

Police reports say Filler thought the teen was skiing carelessly when she bumped into his 4-year-old son. Eagle County sheriff's deputies say that's when he jumped on the girl and hit her with his fist. The girl said she was swerving to avoid another skier.

District Attorney Mark Hurlbert says Filler was sentenced to anger management classes and restitution, the amount of which would be determined by the girl.

Prosecutors also sought community service, but Hurlbert says the judge fined Filler $500 instead.

Three witnesses told deputies they observed Filler punch girl between two and four times.

The ski instructor who pulled the Decatur man off the girl told deputies Filler punched her "at least four times, using a closed fist," sheriff's Lt. Mike McWilliam told the AJC. Two other witnesses said they observed Filler yell at the girl before landing two or three punches, the sheriff's office spokesman said.

Filler, charged with misdemeanor child abuse, told deputies he thought the girl was skiing carelessly and had seriously injured his son. The boy was not hurt, however, and Filler apologized. The girl was treated for minor injuries at a local medical center.

Her father requested charges be filed against Filler, who was banned for life from Vail's six ski resorts.

I can't for the life of me understand why you think that is acceptable...I really can't.

And the fact that you've stayed on this thread this long condoning that attack tells me all I need to know about you and that there is no argument in the world that will make you understand why this was so wrong...........You're one sick bastard.....

Particularily if it is me that you beat the crap out of.

The guy was too hasty in punching around a little girl. One time when I was younger I was sitting in my parked car, and this drunk black guy banged his car into mine while parking. I got out and grabbed the guy by the collar, yelling at him for recklessly hitting my car. I pulled my fist back and was about to punch him in the face, when his girlfriend got out and started screaming at me to let him go. She was pointing a handgun in my face, and her hands were shaking like crazy. I let him go and backed off. The next day I saw her, and she nervously greeted me. All was okay. I've learned that not everyone who bumps into you deserves to die. But someone who deliberately tries to hit you does. It could have been me that time. Just saying...

Time granted, I shall you review your statements.

It appears that trying to understand behaviours is not a real popular activity around here and doing so brings accusations from far left field.

That would have been my thought too, but this is from the first article linked below-

“The victim did not want Filler to be sent to jail, Eagle Country District Attorney Mark Hurlbert said, which is why his office pursued community service, anger-management classes and restitution as punishment.”

And this-

“The judge sentenced him to anger-management classes, restitution but gave him a $500 fee in lieu of community service,” Hurlbert said. “We are still awaiting restitution numbers from the victim.”

I’ve read in other articles that the judge left the amount of restitution up to the young girl. From my point of view, as the mother of a daughter, I hope she decides on a nice high number.

The girl bumped into a 4-year-old boy who had been skiing with his father on the same run, McWilliam said. The boy and girl fell, the statement said.”

“The father of the 4-year-old boy said he thought his son had been seriously hurt and that the girl had been skiing carelessly, McWilliam said. Police said the man jumped on top of the girl and hit her in the face with his fist, McWilliam said in the statement. The skiing instructor intervened and stopped the father from further assaulting the girl, the statement said. The father then realized his son was not injured and apologized for his inappropriate behavior, McWilliam said.”

Apart from jumping on and immediately punching this young girl, I’m tying to imagine the type of man that goes off the deep end so quickly before he even determines if his child has been injured, seriously or otherwise.

Look, you suggested it would be wise to study this guy. For the life of me, I can’t see a reason for it unless it was to gain a way to prevent further crimes like this. If that wouldn’t be the end game here, what possible relevance does an interview deductive process and the mention of a forensic television show have to do with this topic?

Some crimes you can’t prevent. You are left with conviction and sentencing.

No, you didn’t mention local law enforcement. You merely mentioned what 7 plus 3 would equate to, and I made what you think is a stupid determination, by thinking we were both talking about 10.

Look, if we’re going to talk about what seems silly and pointless, let’s just accept that so far you have understood nothing that pertains to this case.

I find that less than fantastic.

A beginner's run is just a very gentle slope designed for people learning to ski. Everywhere I've skied, that's also the definition of a bunny slope.

If you guys think they are different, then please explain to me how.

I didn't say that's the only possible way. However, if you bump into someone who is below you, it is your fault, and it is your responsibility to ski slowly enough so it doesn't happen. Here are the relevant passages from the Skier's responsibility code:

Always stay in control, and be able to stop or avoid other people or objects.
People ahead of you have the right of way. It is your responsibility to avoid them.

Obviously, there are circumstances in which people can innocently bump into each other, such as in a lift line, or at the top of a lift while unloading and someone isn't looking.

However, when skiing down the run, it is your fault if you bump into someone who is below you. Period.

If you hit someone below you and couldn't avoid them, then that means you either weren't looking, or you were skiing too fast for your own ability.

Now before we continue this, let me just step back a bit here.

I'm NOT defending the guy who hit the girl. I'm not condoning his act of hitting the girl.

The only person I'm defending here is the judge. Based on the facts in the public domain, and on what I know about skiing in general and the skiing habits of teenagers in particular, the sentence the judge handed down looks reasonable.

Okay, this is beginning to make sense.

An (highly likely) illegal alien girl taking ski classes, looses control trying to avoid a downed skier and knocks down a four year old.

The four year old’s dad jumps on top of her and pummels her.

Then she says she doesn’t want him arrested.

And why wouldn’t she want him arrested? Because she would have to testify in court, which would require her being identified for the court as an illegal immigrant, possibly causing her whole family grief.

You know folks, I am a very staunch defender of our borders, and a supporter of sending illegal immigrants and their children packing back to Mexico. That DOES NOT mean that I will countenance people committing crimes against illegal alien children or their parents while they are here.

This judge sounds like a complete idiot. “Yes DA, it’s okay if grown-ups hit me in the face with their fists. I don’t want them to go to jail for it.”

How old is the judge, 11? He actually bought into this? Good grief!

Huh? An illegal alien taking ski classes? Do you know how expensive those are? What makes you think this is "highly likely?" Very few illegals would be able to afford something like that.

FYI, most Mexicans who happen to be within US borders at any given point in time are legal.

Probably because she'd rather have him pay her restitution.

I think the judge is very wise. What good does it do the victim in this case to put the guy in jail? Isn't it far better for the victim to make him pay her?
